A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA, DENYING
PLANNING APPLICATION PA -01-26 AND REZONE
PETITION R-01-04.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, an application was filed by Fritz Howser and Michael Schrock,
authorized agents for Phil Wade, with respect to real property located at 257 Cecil
Place, requesting a master plan review to allow construction of two, two-story, single
family residences on an 18,800 square foot property constructed with an existing two-
story single family home, for a total of three units, with a rezone from R1 (Single -Family
Residential) to PDR -LD (Planned Development Residential -Low Density) to
accommodate the development; and
WHEREAS, the Planning Commission held a duly noticed public hearing on
August 27, 2001; and
WHEREAS, on August 27, 2001, the Planning Commission recommended
approval of PA -01-26 and R-01-04; and
WHEREAS, a duly noticed public hearing was held by the City Council on
October 1, 2001, November 5, 2001,and November 19, 2001;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa
Mesa that based on the evidence in the record and the findings contained in Exhibit "A",
the City Council hereby DENIES Planning Application PA -01-26 and Rezone
Petition R-01-04 with respect to the property described above.

EXHIBIT "A"
FINDINGS
A. The rezone to PDR -LD is not consistent with the General Plan and the Zoning
Code. The project is not consistent with the surrounding R1 zoned neighborhood
and is not compatible with the existing homes within the area. Specifically, the 2 -
story homes on lots 1 and 3 are setback less than 20 feet from the rear property
lines of adjacent parcels, which is not consistent with the rear yard setbacks for 2 -
story structures for traditional R1 properties. Additionally, the long, narrow
driveway that provides vehicular access to the two new homes in the rear has a
limited vehicle turnaround area and vehicles would have to back out the length of
the driveway to the street. The creation of two, 2 -story homes in addition to the
existing 2 -story home on the property will reduce the privacy of adjacent properties.
Finally, the zone change would create an isolated PDR -LD zoned parcel
inconsistent with the existing surrounding R1 zoned properties.
B. The proposed project does not comply with Costa Mesa Municipal Code Section
13-29(e) because:
• The proposed development and use is not compatible and harmonious with
uses on surrounding properties.
• The proposed project does not comply with applicable performance standards
prescribed in the Zoning Code.
• The project is not consistent with the General Plan.
C. The project has been reviewed for compliance with the California Environmental
Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures,
and has been found to be exempt from CEQA.
D. The project is exempt from Chapter XII, Article 3, Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.
E. The rear building of this development is at an excessive distance from the street,
but the plan does not lend itself to fire apparatus access or placement of an on-site
fire hydrant.
