D/ - 9'6- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING PLANNING APPLICATION PA -01-19. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by Bruce H. Corzine, owner of real property located at 2950 Airway Avenue, Suite B-3, requesting approval of a conditional use permit to legalize counseling and instructional services for drug and alcohol abuse within an existing industrial building within the MP (Industrial Park)) zoning district; and WHEREAS, after notice of public hearing to consider the request, the Planning Commission approved the planning application on September 24, 2001; and WHEREAS, the planning application was appealed to the City Council on October 1, 2001, and a duly noticed public hearing was held by the City Council on December 3, 2001; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and the findings contained in Exhibit "A", and subject to the conditions of approval contained in Exhibit "B", the City Council of the City of Costa Mesa hereby approves Planning Application PA -01-19 with respect to the property described above. BE IT FURTHER RESOLVED that the Costa Mesa City Council does hereby find and determine that adoption of this resolution is expressly predicated upon the activity as described in the staff report for Planning Application PA -01-19, and upon applicant's compliance with each and all of the conditions contained in Exhibit "B". Any approval granted by this resolution shall be subject to review, modification, or revocation if there is a material change that occurs in the operation, or if the applicant fails to comply with the conditions of approval. The information presented substantially complies with Costa Mesa Municipal Code Section 13-29 (g)(2) in that the proposed use is substantially compatible with developments in the same general area. Granting the conditional use permit will not be detrimental to the health, safety and general welfare of the public or other properties or improvements within the immediate vicinity. The property has adequate parking to accommodate the use (187 spaces required; 254 provided) and is located away from any residential areas. Granting the conditional use permit will not allow a use, density or intensity which is not in accordance with the general plan designation for the property. B. The proposed use complies with Costa Mesa Municipal Code Section 13-29(e) because: ■ The use is compatibltr and harmonious with uses on surrounding properties. ■ Safety and compatibility of the design of the buildings, landscaping, and other site features including functional aspects of the site development such as automobile and pedestrian circulation have been considered. • The project is consistent with the General Plan. ■ The planning application is for a project -specific case and does not establish a precedent for future development. ■ The cumulative effects of all past and present planning applications have been considered for both the subject property and surrounding properties. C. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. D. The project is exempt from Chapter XII, Article 3, Transportation System Management, of Title 13 of the Costa Mesa Municipal Code. EXHIBIT "B" CONDITIONS OF APPROVAL APPL. PA -01-19 Ping. 1. The conditional use permit herein approved shall be valid until revoked, but shall expire upon discontinuance of the activity authorized hereby for a period of 180 days or more. The conditional use permit may be referred to the Planning Commission for modification or revocation at any time if the conditions of approval have not been complied with, if the use is being operated in violation of applicable laws or ordinances, or if, in the opinion of the development services director or his designee, any of the findings upon which the approval was based are no longer applicable. 2. A copy of the conditions of approval for the conditional use permit must be kept on premises and presented to any authorized city official upon request. New business/property owners shall be notified of conditions of approval upon transfer of business or ownership of land. 3. The use shall operate, at all times, in a manner that will allow the quiet enjoyment of the surrounding neighborhood. The applicant and/or operator shall institute whatever measures are necessary to comply with this requirement, including, but not limited to, supervision of the building and parking area by staff or security personnel whenever clients of this use are present on the premises. This condition may be modified as necessary by the Planning Division, but may not be removed without approval by the Planning Commission. 4. The use is limited to a drug and alcohol counseling facility (no medical services provided) within the 2,239 square foot suite. Hours of operation shall be 9 a.m. to 10 p.m., Monday through Friday, and 9 a.m. to 2 p.m., Saturday. 5. The applicant shall submit a parking management plan to the Planning Division addressing parking needs, use of spaces on-site, and on -street parking availability. 6. Changes which have the effect of increasing or intensifying the use shall require filing and approval of a new conditional use permit application and shall be reviewed by the Planning Commission. 7. The attached list of security recommendations is provided by the Police Department for the applicant's consideration. 8. An appropriate drop-off location shall be provided, discussed with, and approved by the Planning Division staff. 9. The applicant shall come before the Commission again in 3 months and again in 9 months for status review. 10. The applicant shall arrange for an immediate inspection by the Building Division and Fire Department for occupancy, health and safety requirements. Proof of compliance shall be submitted to the Planning Division.
