AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, DISSOLVING THE SENIOR COMMISSION AND REPEALING CHAPTER
IV (SENIOR COMMISSION) OF TITLE 12 (PARKS AND RECREATION) OF THE COSTA
MESA MUNICIPAL CODE
WHEREAS, in 2014, the City Council established the Senior Commission
("Commission") after the City assumed full operation of the Costa Mesa Senior Center, which
was previously operated by a non-profit organization; and
WHEREAS, the City Council established the Commission to study and advise the
City Council on matters affecting the senior community and the Senior Center, and
WHEREAS, at the time the City assumed full operation of the Senior Center and
established the Commission, the Senior Center had poor membership, minimal program
offerings, and numerous issues; and
WHEREAS, since 2014, City staff has worked to increase Senior Center
membership, to offer comprehensive program offerings, and to address issues in a proactive
manner, resulting in a well-managed, thriving facility; and
WHEREAS, the City Council believes that the Senior Center can be sufficiently
represented by a designated liaison from the Parks, Arts and Community Services
Commission, such that the Commission can be dissolved; and
WHEREAS, dissolving the Commission would decrease costs to the City associated
with monthly compensation paid to Commissioners as well as costs associated with staffing
and maintaining the Commission; and
WHEREAS, the City Council desires to dissolve the Commission and to repeal
Chapter IV (Senior Commission) of Title 12 (Parks and Recreation) of the Costa Mesa
Municipal Code relating to the Commission.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. The Senior Commission is hereby dissolved.
Section 2. Chapter IV of Title 12 of the Costa Mesa Municipal Code is hereby
deleted in its entirety.
Section 3. Environmental Compliance. This Ordinance has been reviewed for
compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines,
and the City's environmental procedures, and has been found to be exempt pursuant to
Section 15061(b)(3) (General Rule) of the CEQA Guidelines because it can be seen with
certainty that there is no possibility that the passage of this Ordinance will have a significant
effect on the environment.

Section 4. Inconsistencies. Any provision of the Costa Mesa Municipal Code or
appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such
inconsistencies and no further, is hereby repealed or modified to that extent necessary to
effect the provisions of this Ordinance.
Section 5. Severability. If any section, subsection, sentence, clause, phrase or
portion of this Ordinance is for any reason held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall not affect the validity of
the remaining portions of this Ordinance. The City Council of the City of Costa Mesa hereby
declares that it would have adopted this Ordinance and each section, subsection, sentence,
clause, phrase, or portion thereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional.
Section 6. Effective Date. This Ordinance shall take effect thirty (30) days after
its final passage.
Section 7. Certification. The City Clerk shall certify to the passage and adoption
of this Ordinance and shall cause the same to be published or posted in the manner required
by law.

that the above and foregoing Ordinance No. 19-07 was duly introduced for first reading at
the regular meeting of the City Council of the City of Costa Mesa held on the 19th day of
March, 2019, and that thereafter, said Ordinance was duly passed and adopted at a regular
meeting of the City Council held on the 2nd day of April, 2019, by the following roll call vote,
to wit:
