A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA
SUPPORTING SENATE BILL 689 TO ALLOW LOCAL CONTROL OVER THE
AUTHORIZATION OR REAUTHORIZATION OF NEEDLE EXCHANGE PROGRAMS
UNDER THE DEPARTMENT OF PUBLIC HEALTH.
WHEREAS, the California Health and Safety Code currently allows the State
Department of Public Health to authorize entities to perform hypodermic needle and
syringe exchange services in any location where the department determines that the
conditions exist for the rapid spread of potentially deadly or disabling infections that are
spread through the sharing of used hypodermic needles and syringes; and
WHEREAS, such authorization has been provided by the State Department of
Mental Health to a mobile needle exchange program to operate in the City of Costa Mesa;
and
WHEREAS, the city is currently involved in litigation over this authorization, with
the court recently issuing a preliminary injunction preventing the operation of the mobile
needle exchange program, finding that the risk of harm from syringe litter is substantial;
and
WHEREAS, Senate Bill 689 would amend the California Health and Safety Code
to only allow the State Department of Health to authorize hypodermic needle and syringe
exchange services in a city or county if that city or county has adopted a resolution or
ordinance allowing such authorization; and
WHEREAS, by supporting this legislation, the City Council is not condemning all
needle exchange programs, but is communicating a desire for local control over programs
that affect the local community.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa
Mesa supports Senate Bill 689 and the efforts to provide local control over an issue
important to our communities and asks the California Legislature to pass SB 689.
