HomeMy WebLinkAbout19-38 - Adjusting the Building Permit Fee Schedule for Fiscal Year 19-20RESOLUTION NO. 19-38 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ADJUSTING THE BUILDING PERMIT FEE SCHEDULE FOR FISCAL YEAR 2019-2020 THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City Council of the City of Costa Mesa has established various schedules of rates, fees, and charges for services provided by the City; and WHEREAS, pursuant to the provisions of the California Constitution and the laws of the State of California, the City is authorized to adopt and implement rates, fees, and charges for municipal services; provided, however, that such rates, fees, and/or charges do not exceed the estimated reasonable cost of providing such services; and WHEREAS, California Government Code Section 66016 et seq. require that the City Council conduct a properly noticed public hearing at a regularly scheduled meeting prior to the adoption of new rates, fees, and charges, or prior to adoption of increases in existing rates, fees, and charges; and WHEREAS, in accordance with California Government Code Section 66016 et seq., the City Council adopted a Building Permit Fee Schedule through the adoption of Resolution No. 18-44 on June 19, 2018; and WHEREAS, Section 5 of Resolution No. 18-44 provides that the Building Permit Fee Schedule shall be adjusted annually from July 1, 2019 by an escalation factor equal to the changes in the Consumer Price Index for All Urban Consumers for the Los Angeles — Riverside — Orange County Area ("CPI -U"), published by the U.S. Department of Labor, Bureau of Labor Statistics, which shall be calculated each May based on changes in the CPI -U from the previous May; and WHEREAS, Section 5 of Resolution No. 18-44 further provides that the adjusted fees will be reflected in an annual fee resolution; and WHEREAS, the change in the CPI -U for the Los Angeles -Long Beach -Anaheim Area from May 2018 to May 2019 was 3.1 percent; and WHEREAS, the fees set forth in the Building Permit Fee Schedule were adjusted based on the 3.1 percent increase; and Resolution No. 19-38 Page 1 of 12 WHEREAS, the adjusted fees will allow the City to recover the reasonable costs incurred by the City in providing the services; and WHEREAS, henceforth the City Council desires to authorize the City Manager or his/her designee to adjust the Fee Resolution annually as long as annual increases shall not exceed the reasonable costs incurred by the City in providing the services; and WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa as follows: Section 1. The City Council hereby finds and determines that based upon the data, information, and analysis presented to the City Council concerning the rates, fees, and charges described in Exhibit "A," attached hereto and incorporated herein by this reference, the rates, fees, and charges set forth in Exhibit "A" do not exceed the established reasonable cost of providing the services for which the rates, fees, or charges are levied. Section 2. The rates, fees, and charges set forth in Exhibit "A" are hereby adopted and approved as the rates, fees, and charges for the services identified for each such rate, fee, and/or charge for the 2019-2020 Fiscal Year effective immediately. Section 3. Henceforth, the annual CPI -U adjustment shall not require the approval of an annual fee resolution by the City Council and may be authorized by the City Manager or his/her designee effective July 1 st of each successive year. Section 4. In no event shall an increase in any rate, fee, or charge exceed the reasonable cost of providing the service for which such rate, fee, or charge is identified. Section 5. In the event of any inconsistency between this Resolution and Resolution No. 18-44, the provisions of this Resolution shall prevail. Section 6. The City Clerk shall certify to the passage and adoption of this Resolution and shall enter it into the book of original resolutions.
