HomeMy WebLinkAbout00-15 - Opposing Senate Bill 739, Local Government Collective BargainingRESOLUTION NO. 00- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, OPPOSING SENATE BILL 739, LOCAL GOVERNMENT COLLECTIVE BARGAINING. WHEREAS, the California Legislature is considering Senate Bill 739 (SB 739) authored by Senator Solis, which authorizes an agency shop arrangement without a negotiated agreement upon a signed petition by 30 percent of the employees in a bargaining unit and majority vote on the issue; and WHEREAS, SB 739 authorizes binding arbitration over collective bargaining agreement interpretation or application; and WHEREAS, SB 739 expands the jurisdiction of the Public Employment Relations Board TERB) to include resolving disputes and enforcing the statutory duties and rights of employers and employees under the Meyers-Milias-Brown Act; and WHEREAS, SB 739 codifies the right of public employees to strike; and, WHEREAS, SB 739 imposes a clear and costly mandate on local public agencies, both in the process and effect; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA declares its opposition to Senate Bill 739, and calls upon State legislators to recognize the importance of local control, and to vote against this unreasonable and inappropriate intrusion on local authority and control over the collective bargaining process for City of Costa Mesa employees.
