HomeMy WebLinkAbout00-41 - Denying Development Review DR-00-05RESOLUTION NO. 00 - 4 / A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DENYING DEVELOPMENT REVIEW DR -00-05. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by James Cefalia, owner of real property at 2087 Garden Lane, requesting planning staff approval of Development Review DR -00-05, to construct five (5) detached residential units within the R2 -MD zone; and WHEREAS, on April 6, 2000, planning staff approved Development Review DR -00-05 subject to conditions of approval; and WHEREAS, an appeal of the planning staff's approval of Development Review DR -00-05 was submitted by City Council Member Somers on April 12, 2000; and WHEREAS, on May 8, 2000, the Planning Commission held a duly noticed public hearing at which Development Review DR -00-05 was approved; and WHEREAS, an appeal of the Planning Commission's decision to approve Development Review DR -00-05 was submitted by City Council Member Somers on May 12, 2000; and WHEREAS, a duly noticed public hearing was held by the City Council on June 5, 2000; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and the findings contained in Exhibit "A", the City Council hereby denies Development Review DR -00-05 with respect to the property described above. PASSED AND ADOPTED this 5th day of June, 2000. The project is not compatible and harmonious with other developments, the uses in the area of the project will generate excess traffic and parking needs, the site cannot accommodate the excess parking and the existing demand for street parking and parking generated by the primary school in relation to student pickup and drop-off, and the problem is exacerbated by the substandard length of the proposed driveways which cannot accommodate an overflow of parking on-site.
