The minor design review for the above-referenced project has been completed. The
application has been approved, based on the following project description and
findings, subject to the conditions set forth below:
PROJECT DESCRIPTION
The existing single-story, single-family residence consists of 4 bedrooms, 2
bathrooms and a nonconforming garage (20' interior width required; 18' existing�.
The applicant requests a minor design review for a second story addition and an
exemption from the garage width requirement. The proposal is for a garage
extension, living room/entry extension and a closet addition at the front of the first
floor, and a new master bedroom suite on the second floor. The first floor closet
addition necessitates a minor modification, but encroaches into the required 20'
front setback no further than the existing main structure (17.5').
ANALYSIS
A minor design review is required for any 2nd floor addition in the R1 (Single Family
Residence) zone to ensure proper design consideration and compatibility with
surrounding properties. •
With exception of the nonconforming garage, the proposal conforms to all
development standards and the residentiai design guidelines. The second story
floor area is approximately 42% of the first floor area (932 sq. ft. including area

open to below/2,213 sq. ft) and is well integrated with the first fioor configuration.
The proposed construction also incorporates variation in roof forms and orientation.
Staff has conducted a site inspection and determined that the addition would not
negatively impact the surrounding properties or aesthetics of the neighborhood.
Although there are no two-story homes immediately adjacent to the project site, the
proposed addition would not appear out of place or obtrusive because the second
floor area is relatively small in comparison to the first floor, and building mass is
reduced since it is set back further than the first floor and incorporates variation in
building heights and forms to create a smoother transition from the first to second
story. The proposed 2"d fioor addition will not intrude on adjoining properties
because it is centrally located on the property with approximately 23' left (east)
side setback, 1 6' right (west) side setback, and 27' rear (south) setback.
The Zoning Code allows an exemption from current parking requirements (20' x 20'
interior garage dimensions) for an existing residence with legal, nonconforming
garage dimensions if the existing structure on the lot precludes reasonable
compliance with off-street parking requirements. In this case, there is not enough
side yard area to allow expansion of the garage to meet current garage width
requirements. Since the garage can still accommodate 2 cars and the driveway
provides 2 open parking spaces, no parking impacts are anticipated.
Code allows a minor modification for minor building additions that encroach into
required setbacks no further than the existing main structure. The existing
structure has a nonconforming front setback (20' required; 17.5' existing) for a 1 5'
portion of the house. The 4' closet addition on the first floor will line up with the
existing main structure and would not negativeiy impact the neighborhood.
FINDINGS
1. The information presented sub.stantiaily complies with Section 13-29(e) and
13-29(g)114) of the Costa Mesa Municipal Code in that:
a. , The proposed development and use is compatible and harmonious with
uses on-site as well as those on the surrounding properties. With
exception of the existing nonconforming garage width, the project meets
or exceeds all residential development standards and design guidelines.
b. Safety and compatibility of the design of the buildings, parking areas,
landscaping, luminaries, and other site features including functional
aspects of the site development such as automobile and pedestrian
circulation have been considered.
c. The project is consisient with the General Plan.

d. The planning application is for a project-specific case and does not
establish a precedent for future development.
e. The proposed development is substantially compatible and harmonious
with existing and/or anticipated development on surrounding properties.
This includes site planning, landscaping, appearance, scale of structures,
location of windows, and any other applicabfe features relative to a
compatible and attractive development. The second floor addition is
relatively small in comparison to the first floor and incorporates varying
roof heights and forms to create an interesting building mass.
Consideration is also given to the effect of proposed development on the
light, air, and privacy of adjacent properties. The exemption from current
parking requirements will not create an impact in the neighborhood
because the nonconforming garage can still hold 2 cars inside and the
driveway provides 2 open parking spaces.
2. The project has been reviewed for compliance with the California Environmental
Quality Act (CEQA1, the CEQA Guidelines, and the City environmental
procedures, and has been found to be exempt from CEQA.
3. The project is exempt from Chapter XII, Article 3 Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.
CONDITIONS OF APPROVAL
Ping. 1. Street address shall be displayed on the fascia adjacent to the main
entrance or front door in a manner visible from the public street.
Numerals shall be a minimum 6" in height with not less than Yz" stroke
and shall contrast sharply with the background.
2. All new and existing construction shall be architecturally compatible with
regard to building materials, style, colors, etc. Plans submitted for plan
check shall indicate how this will be accomplished.
3. The conditions of approval and ordinance or code provisions of minor
design review ZA-03-23 shali be blueprinted on the face of the site plan
as part of the plan check submittal package.
4. The applicant shall contact the Pianning Division to arrange for a Planning
inspection of the site prior to the reiease of occupancy/utilities. This
inspection is to confirm that the conditions of approval and code
requirements have been satisfied.
Eng. 5. Maintain the public right-of-way in a"wet-down" condition to prevent
excessive dust and promptly remove any spillage from the pubiic right-of-
way by sweeping or sprinkling.

CODE REQUIREMENTS
The following list of federal, state and local laws applicable to the project has been
compiled by staff for the applicant's reference. Any reference to "City" pertains to
the City of Costa Mesa.
Ping. 1. Approval of the Zoning Action is valid for one (1) year and will expire
at the end of that period unless buiiding permits are obtained or the
applicant applies for and is granted an extension of time.
2. All contractors and subcontractors must have valid business licenses to
do business in the City of Costa Mesa. Final inspections wil� not be
granted until all such licenses have been obtained.
Bldg. 3. Comply with the requirements of the California Code of Regulations,
Title 24, also known as the California Building Standards Code, as
amended by the City of Costa Mesa.
4. Prior to or concurrent with the submittal of plans for grading/building/
plan check/submittal of final subdivision map for engineering plan check,
the applicant shall prepare and submit documentation for compliance
with the State Water Resources Control Board (SWRCB) Water Quality
Order 99-08-DWQ; National Pollutant Discharge Elimination System
(NPDES) Permit No. CAS000002 for Storm Water Discharges
Associated with Construction Activity (General Permit); the California
Regional Water Quality Controi Board (RWQCB) Santa Ana Region Order
No. R8-2002-0010 and NPDES Permit No. CAS618030; and, the City of
Costa Mesa Ordinance No. 97-20 for compliance with NPDES Permit for
the City of Costa Mesa. Such documentation shall include a Storm
Water Pollution Prevention Plan if over 1 acre (if over 5 acres if
submitted prior to March 10, 2003) and a Water Quality Management
Plan (WQMP) identifying and detailing the implementation of the
applicable Best Management Practices (BMPsI.
Fire 5. Provide approved smoke. detector to be installed in accordance with the
1 997 Edition of the Uniform Fire Code.
Eng. 6. At the time of development submit for approval an off-site plan to the
Engineering Division and grading plan to the Building Division that shows
sewer, water, existing parkway improvements and the limits of work on
the site, both prepared by a civii engineer or architect. Construction
access approval must be obtained prior to building or engineering permits
being issued by the City of Costa Mesa. Pay offsite plan check fee to
the Engineering Division. An approved offsite plan and fee shall be
required prior to engineering/utility permits being issued by the City.
7. A site access permit and deposit of 5350 for street sweeping will be
required by the Engineering Division prior to the start of any on- or off-
site work.
