A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING PLANNING APPLICATION PA -00-30. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by Chip Collins, authorized agent for B.R.E. Properties, with respect to real property located at 1250 Adams Avenue, requesting approval of a variance to allow excess compact spaces (0 permitted, 102 proposed, 54 existing), and to increase the total number of parking stalls for an existing apartment complex from 458 to 481; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on September 11, 2000, at which time the Planning Commission approved Planning Application PA -00-30; and WHEREAS, PA -00-30 was appealed to the City Council; and WHEREAS, a duly noticed public hearing was held by the City Council on October 16, 2000; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and the findings contained in Exhibit "A", and subject to conditions contained in Exhibit "B", the City Council hereby approves Planning Application PA -00-30 with respect to the property described above. BE IT FURTHER RESOLVED that the Costa Mesa City Council does hereby find and determine that adoption of this resolution is expressly predicated upon the activity described in the staff report for Planning Application PA -00-30, and upon applicant's compliance with each and all conditions contained in Exhibit "B". Any approval granted by this resolution shall be subject to review, modification, or revocation if there is a material change that occurs in the operation, or if the applicant fails to comply with any of the conditions of approval. The information presented substantially complies with Costa Mesa Municipal Code section 13-29(g)(1) in that, because special circumstances applicable to the property exist (such as an unusual lot size, lot shape, topography, or similar features). Specifically, the applicant cannot provide the 25 -foot back -out area required for full size 90 -degree stalls and still retain the same number of covered parking spaces existing on site. The lack of necessary width in the northerly portion of the site to accommodate full-size stalls creates a special circumstance where approval of the requested variance is justified. The granting of the deviation will not allow a use, density, or intensity which is not in accordance with the general plan designation for the property. B. The proposed project complies with Costa Mesa Municipal Code Section 13- 29(e) because: 1. The proposed development and use is compatible and harmonious with uses both on-site as well as with those•on surrounding properties. 2. Safety and compatibility of the design of the buildings, parking areas, landscaping, luminaries, and other site features including functional aspects of the site development such as automobile and pedestrian circulation have been considered. 3. The proposed project complies with applicable performance standards prescribed in the Zoning Code. 4. The project is consistent with the General Plan. 5. The planning application is for a project -specific case and does not establish a precedent for future development. 6. The cumulative effects of all past and present planning applications have been considered for both the subject property and surrounding properties. C. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. D. The project, as conditioned, is exempt from Chapter XII, Article 3, Transportation System Management, of Title 13 of the Costa Mesa Municipal Code. EXHIBIT "B" CONDITIONS OF APPROVAL APPL. PA -00-30 Ping. 1. The applicant shall contact the Planning Division to arrange for a "special requirements" inspection of the site prior to the commencement of the use. This inspection is to confirm that the conditions of approval and code requirements have been satisfied. 2. The conditions of approval and ordinance or code provisions of PA - 00 -30 shall be blueprinted on the face of the site plan as part of the plan check submittal package. 3. Turn -around area(s) shall be striped and marked for no parking. 4. To avoid an alley -like appearance, if the driveways are paved with asphalt, they shall be developed without a center concrete swale. Design shall be approved by the Planning Division. 5. Concrete wheel stops shall be installed 2 feet from the front edge of open parking spaces, or where applicable, landscape planters shall be increased 2 feet in depth to allow curbing to serve as a wheel drop. 6. Existing mature vegetation shall be retained wherever possible. Should it be necessary to remove existing vegetation, the applicant shall submit a written request and justification to the Planning Division. A report from a California licensed arborist may be required as part of the justification. Replacement trees shall be 24 -inch box size of larger, and shall be replaced on a 3 to -1 basis, subject to the approval of the Planning Division. The replacement trees shall be planted within the northerly parking area. Any tree not able to fit on site, shall be donated to the City. This condition shall be completed under the direction of the Planning Division. 7. The applicant shall plant vine pockets along the northerly property line fence. 8. Any new parking area lighting shall comply with all requirements of Costa Mesa Municipal Code Section 13-93(d) without creating spillover light or glare onto adjacent properties. Shielding or other methods necessary to prevent light or glare spillover shall be incorporated. 9. To ensure maximum efficiency of parking use, management shall establish, maintain, inform tenants of, and enforce a policy regarding use of parking spaces. Said policy shall include prohibitions against long-term storage of vehicles, storage of inoperative vehicles, and parking of vehicles other than within designated parking stalls. 10. Security gate plans, including provisions for emergency access, shall be submitted to the Planning Division for review and approval prior to installation. 11. Carport design shall be submitted to the Planning Division for review and approval prior to issuance of building permits. Carports shall be designed with sensitivity to views from adjacent single- family homes and public streets. Trans. 12. Show locations of all gates for all- driveways on site plan. CODE REQUIREMENTS The following list of federal, state and local laws applicable to the project has been compiled by staff for the applicant's reference. Any reference to "City" pertains to the City of Costa Mesa. Ping. 1. All contractors and subcontractors must have valid business licenses to do business in the City of Costa Mesa. Final inspections, final occupancy and utility releases will not be granted until all such licenses have been obtained. 2. Approval of the planning application is valid for one (1) year and will expire at the end of that period unless building. permits are obtained and business commences, or the applicant applies for and is granted an extension of time:' 3. Development shall comply with all applicable requirements of Section 13-85 of the Costa Mesa Municipal Code relating to residential parking standards. 4. Parking stalls shall be double -striped in accordance with City standards. 5. All compact parking spaces shall be clearly marked "compact" or "small car only". 6. Four (4) sets of detailed landscape and irrigation plans shall be required as part of the project plan check review and approval process. Three (3) sets shall be provided to the representative water agency and one (1) set shall be submitted to the Planning Division for review. Plans shall be approved by'the water agency with two (2) approved sets forwarded by the applicant to the Planning Division for final approval prior to issuance of building permits. 7. Two (2) sets of landscape and irrigation plans, approved by both' the water agency and the Planning Division, shall be attached to two of the final building plan sets. 8. Plans for new landscaping and irrigation shall meet the requirements set forth in Costa Mesa Municipal Code Sections 13-101 through 13-108 as well as irrigation requirements set forth by the water agency. Consult with the representative water agency Mesa Consolidated Water District, Ray Barela - (949) 631-1291 for requirements. 9. Landscaping and irrigation shall be installed in accordance with the approved plans prior to final inspection or occupancy clearance. 10. All landscaped areas shall be separated from paved vehicular areas by 6" high continuous Portland Cement Concrete curbing. 11. Trash enclosures or other acceptable means of trash disposal shall be provided. Design of trash enclosures shall conform with City standards. Standard drawings are available from the Planning Division. 12. Construction, grading, materials delivery, equipment operation or other noise -generating activity shall be limited to between the hours of 7 a.m. and 8 p.m., Monday through Friday, or between the hours of 8 a.m. and 7 p.m., on Saturday, Sunday, and Federal holidays. Exceptions may be made for activities that will not generate noise audible from off-site, such as painting and other quiet interior work. Bldg. 13. Comply with the requirements of the Uniform Building Code pertaining to "Disabled Access Regulations". Fire 14. Provide "blue dot" reflective markers for all on-site fire hydrants. SPECIAL DISTRICT REQUIREMENTS The requirement of the following special district is hereby forwarded to the applicant: State 1. Comply with the requirements of the California Department of Food and Agriculture (CDFA) to determine if red imported fire ants (RIFA) exist on the property prior to any soil movement or excavation.
