Dear Mr. Ryan: .
The Development Review for the above-referenced 'project has been completed.
The various City departments have recommended approval of the proposed
construction based on •the following description and findings, and subject to the
following conditions:
DESCRIPTION
Proposed is a 1 ,750 sq.ft. second-floor addition to an existing, single-family
residence. The addition includes three bedrooms and bathrooms in addition to the
three bedrooms and bathrooms already existing on the ground floor. The existing
three-car garage satisfies the parking requirement since the same amount of parking
is required for a three-bedroom or a six-bedroom residence.
Two balconies are proposed; however, the one at the rear of the residence will
need to be deleted because it encroaches into the required 20-foot rear setback. If
the applicant wishes to retain the balcony at the front of the house, it will need to
be modified to satisfy the maximum projection permitted through a minor
modification (minimum setback of 16'0").
Staff noted that a six-foot high fence exists along portions of the property line on
both East 161h Street and Tustin Avenue. Code requires a minimum ten-foot
setback along East 16`h Street since it is the front of the property. New Code
requirements may require a 20-foot setback for fences in the front of the property.

A condition has been included requiring compliance with Code standards applicable
at the time of construction.
With the exception of the balconies and fencing, all applicable development
standards are proposed to be satisfied. The addition also satisfies the new
residential development standards City Council will consider at their meeting of 5
May 2001 :
FINDINGS
A. The proposed project complies with Costa Mesa Municipal Code Section 13-
29 (e) because:
a. The proposed development and use is compatible and harmonious with .
• uses both on-site as well as those on surrounding properties.
b. Safety and compatibility of the design of the buildings, parking areas,
landscaping, luminaries, and other site features including functional
aspects of the site development such as automobile and pedestrian
circulation have been considered.
c. The proposed project complies with applicable performance standards
prescribed in the Zoning Code.
d. The project is consistent with the General Plan.
e. The planning application is for a project-specific case and does not
establish a precedent for future development.
f. The cumulative effects of all past and present planning applications
have been considered for both the subject property and surrounding
properties.
B. The project has been reviewed for compliance with the California Environmental
Quality Act (CEQA), the CEQA Guidelines, and the City environmental
procedures, and has been found to be exempt from CEQA.
C. The project is exempt from Chapter XII, Article 3, Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.
CONDITIONS OF APPROVAL
Ping. 1 . Street address shall be displayed on the fascia adjacent to the main
entrance or front door in a manner visible from the public street, and on
the building face/wall/fence visible to the public alley, if applicable.
Numerals shall be a minimum 6" in height with not less than 1/2" stroke
and shall contrast sharply with the background.
2. All new construction shall be architecturally compatible with regard to
building materials, style, colors, etc. with the existing structure. Plans •

submitted for plan check shall indicate how this will be accomplished.
3, Second floor windows shall be designed and placed to minimize direct
lines-of-sight into windows on adjacent neighboring properties, and to
minimize visibility into abutting residential side and rear yards. Every
effort shall be made to maintain the privacy of abutting property
owners. Prior to issuance of a building permit, applicant shall provide a
window placement study demonstrating compliance with this
condition.
4. The applicant shall contact the Planning Division to arrange for a "special
requirements" inspection of the site prior to the release of utilities. This
inspection is to confirm that the conditions of approval and code
requirements have been satisfied.
5. Due to parking limitations, a land use restriction, prepared by Planning .
- staff, shall be signed and recorded by the property owner limiting use
of the site and residence to a single-family residence.
6. The existing fence on the property lines along Tustin Avenue and East
1 6th Street shall be relocated in compliance with applicable codes in
effect at the time building permits are issued.
7. The balcony at the rear of the residence shall be deleted. If the
applicant wishes to retain the balcony at the front of the property, the
balcony shall be modified to a maximum projection of 4 feet into the
required 20-foot front setback and the applicant shall request a minor
modification for the encroachment.
Eng. 8. Maintain the public right-of-way in a "wet-down" condition to prevent
excessive dust and promptly remove any spillage from the public right-
of-way by sweeping or sprinkling.
CODE REQUIREMENTS
The following list of Federal, State, and local laws applicable to the project has been
compiled by Staff for the applicant's reference. Any reference to "City" pertains to
the City of Costa Mesa.
Ping. . 1 . All contractors and subcontractors must have valid business licenses
to do business in the City of Costa Mesa. Final inspections, final
occupancy and utility releases will not be granted until all such
licenses have been obtained.
2. Approval of the development review is valid for one (1 ) year and will
expire at the end of that period unless building permits are obtained
and construction commences or the applicant applies for and is
granted an extension of time.
3, The applicant is advised that amendments to the residential
development standards are scheduled for City Council consideration

on May 5, 2001 . If building permits are not obtained before the new
ordinance becomes effective, additional processing and/or
modification of the plans may be required to comply with the new
requirements.
4. Development shall comply with all requirements of Section 13-38 of
Title 13 of the Costa Mesa Municipal Code relating to development
standards for multi-family residential projects. Applicable standards
will be those in effect at the time building permits are issued.
5. All new on-site utility services shall be installed underground or
provisions made for future undergrounding, if it is impractical at this
time.
• 6. Installation of any new utility meters shall be performed in a manner
so as to obscure the installation from view from any place on or off .
the property. The installation shall be in a manner acceptable to the
public utility and shall be in the form of a vault, wall cabinet, or wall
box under the direction of the Planning Division.
7. All property line walls or fences shall be repaired or replaced as
necessary under the direction of the Planning Division.
8. The interior side elevation of the residence will be finished as
completely as the other three elevations'\with the same materials and
details.
Fire 9. Provide approved smoke detectors to be installed in accordance with
the 1991 Edition of the Uniform Fire Code.
Bldg. 9. Comply with the requirements of the Uniform Building Code as to
design and construction.
Eng. 10. At the time of development submit for approval an off-site plan to the
Engineering Division and grading plan to the Building Division that
shows sewer, water, existing parkway improvements and the limits of
work on the site, and hydrology calculations, both prepared by a civil
engineer or architect. Construction access approval must be obtained
prior to building or engineering permits being issued by the City of
Costa Mesa. Pay offsite plan check fee to the Engineering Division.
An approved offsite plan and fee shall be required prior to
engineering/utility permits being issued by the City.
11 . A site access permit and deposit of $500.00 for street sweeping will
be required by the Engineering Division prior to the start of any on- or
off-site work.
12. Submit required cash deposit or surety bond to guarantee construction
of offsite street improvements at time of permit per Costa Mesa
Municipal Code Section 15-32, and as approved by City engineer.
Cash deposit or surety bond amount to be determined by the City
engineer.

development and then remove any existing driveways and/or curb
depressions that will not be used and replace with full height curb and
sidewalk at applicant's expense.
SPECIAL DISTRICT REQUIREMENTS
The requirements of the following special districts are hereby forwarded to the
applicant:
Sani. 1 . Developer shall contact the Costa Mesa Sanitary District at (949) 631-
1731 for current district requirements.
School 2. Pay applicable Newport Mesa Unified School District fees to the .
Building Division prior to issuance of building permits.
Once again, the above conditions, Code and Special District requirements must be
printed on the face of the site plan prior to submittal of the working drawings.
The decision will become final seven days from the date of this letter, unless
appealed by an affected party or a member of the Planning Commission or City
Council.
