The application has been approved, based on the following project description and findings, subject to the conditions set forth below: PROJECT DESCRIPTION • The subject property contains two detached residences, a one-story residence at the front of the property (the subject of this request) and a two-story residence at the rear of the property. The subject residence is a two bedroom, one bathroom unit with a detached garage and room. Although not attached to the main residence by walls, the roof attaches the garage and room. The room at the rear of the garage is 352 square feet in size and contains a bathroom with a sink, toilet and bathtub, as well as a kitchen with sink, counter top, and two sets of overhead cabinets. The bathroom and kitchen were installed without permits, and under code the kitchen constitutes an illegal third unit on the property. The applicant is requesting a minor conditional use permit to legalize the construction as a bedroom by retaining the bathroom, removing the kitchen sink and counter top, and the overhead cabinets closest to the entry door. A condition of approval has also been incorporated requiring a land use restriction be recorded on the property to inform future property owners that the bedroom shall not contain a kitchen and shall not be used as a living unit. FINDINGS A. The minor conditional use permit substantially complies with Costa Mesa Municipal Code Section 13-29(g)(2) in that the proposed use is substantially compatible with the existing use. C. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. D. The project is exempt from Chapter XII, Article 3, Transportation System Management, of Title 13 of the Costa Mesa Municipal Code. CONDITIONS OF APPROVAL Ping. 1. The conditions of approval and ordinance or code provisions and special district requirements of ZA-04-87 shall be blueprinted on the face of the site plan. 2.
