Based on the following project description and findings, the application has been approved, subject to the conditions set forth below. PROJECT DESCRIPTION The subject property is presently improved with a one-story, single-family residence, an • attached two-car garage, a swimming pool, and a spa. A minor conditional use permit is required to construct a new, 40 square-foot, free- standing bathroom adjacent to the spa in the rear yard. The proposed accessory structure (bathroom) contains a toilet, sink, and shower. The applicant would like to have the fixtures installed for the convenience of those using the swimming pool and spa. A land use restriction is not necessary for the proposed structure since it is too small to be converted into a living area. Consequently, the potential to convert the structure to a dwelling unit is unlikely. FINDINGS A. The information presented complies with Costa Mesa Municipal Code Section 13-29(g)(2) in that the proposed improvement is compatible with developments in the same general area. Granting the minor conditional use permit will not be detrimental to the health, safety, and general welfare of the public or other properties or improvements within the immediate vicinity. Specifically, the proposed bathroom is only 40 sq. ft., enough area to accommodate only a toilet, sink, and shower. Consequently, the potential to convert the structure to a dwelling unit is unlikely. Granting the minor conditional use permit will not allow a use, density, or intensity that is not in accordance with the general plan designation for the property. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. C. The project is exempt from Chapter XII, Article 3, Transportation System Management, of Title 13 of the Costa Mesa Municipal Code. CONDITIONS OF APPROVAL Ping. 1. The detached accessory structure (bathroom) shall be served from the same utility meters (electric, gas, and water) as the main dwelling unit on the property. 2. Construction, grading, material delivery, equipment operation, or other noise- generating activity shall be limited to between the hours of 7 a.m. and 8 p.m., Monday through Friday, and between the hours of 8 a.m. and 6 p.m. on Saturday. Noise-generating activity shall not be allowed on Sunday or Federal holidays. Exceptions may be made for activities that will not generate noise audible from off site, such as painting and other quiet interior work. 3. The applicant shall contact the Planning Division to arrange for an inspection of the site prior to the release of utilities. The second floor is also well integrated with the first floor configuration and the proposed construction incorporates variation in roof forms, orientation and pitch. The elevations incorporate a combination of wood siding and stucco as well as multiple building planes and offsets for an interesting building mass. The second floor windows and deck are placed to minimize direct views into the windows of existing, neighboring structures. All the windows proposed on the right (east) side are non-viewing windows (i.e. bathroom, closet, staircase) to provide light into the rooms. The bedroom windows on the left (west) will not have a privacy impact on the adjacent residence because in addition to the 5 ft. side setback, the property is separated from the adjacent residence by a 10 ft. wide driveway. There are also no bedroom windows on that side of the neighboring residence. A 2"° floor deck is located behind the master bedroom on the left (west) side of the property, where it overlooks the neighbor's driveway area. No privacy impact on the residence to the rear is anticipated because the deck and windows are set back approximately 63 ft. to 70 ft. from the rear property line. The two adjoining property owners on 23' Street have reviewed the plans and have no objections to the 2n° floor addition. Letters stating as much, with property owner signatures, are included in the project file. The garage as shown on the floor plan, is 19.5 ft. wide. However, the applicant is planning to widen it to a minimum 20 ft. interior dimension. A condition has been included to require that the plans be revised to show such dimension at the time of submittal for plan check. FINDINGS 1 . The information presented substantially complies with Section 13-29(e) and 13-29(g)(14) of the Costa Mesa Municipal Code in that: a. The proposed development and use is compatible and harmonious with uses on-site as well as those on the surrounding properties. The project meets or exceeds all residential development standards and the residential design guidelines. b. Safety and compatibility of the design of the buildings, parking areas, landscaping, luminaries, and other site features including functional aspects of the site development such as automobile and pedestrian circulation have been considered. ZA-02-67 October 31, 2002 Page 3 c. The project is consistent with the General Plan. d. The planning application is for a project-specific case and does not establish a precedent for future development. e. The proposed development, as conditioned, is substantially compatible and harmonious with existing and/or anticipated development on surrounding properties. This includes site planning, landscaping, appearance, scale of structures, location of windows, and any, other applicable features relative to a compatible and attractive development. The neighborhood consists of a mixture of 1- and 2-story structures. The elevations incorporate projections and offsets to create an interesting building mass and the design of second floor windows will minimize views into adjacent residences. • 2. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. 3. The project is exempt from Chapter XII, Article 3 Transportation System Management, of Title 13 of the Costa Mesa Municipal Code. CONDITIONS OF APPROVAL Ping. 1 . Street address shall be displayed on the fascia adjacent to the main entrance or front door in a manner visible from the public street. Numerals shall be a minimum 6" in height with not less than '/z " stroke andhshail contrast sharply with the background. 2. The site and floor plan shall be revised to reflect a minimum 20 ft. interior width for the garage as part of the plan check submittal package. 3. The subject property's ultimate finished grade level may not be filled/raised in excess of 30" above the finished grade of any abutting property. If additional fill dirt is needed to provide acceptable onsite stormwater flow to a public street, an alternative means of accommodating that drainage shall be approved by the City's Building Official prior to issuance of any grading or building permits. Such alternatives may include subsurface tie-in to public stormwater facilities, subsurface drainage collection systems and/or sumps with mechanical pump discharge in-lieu of gravity flow. If mechanical pump method is determined appropriate, said mechanical pump(s) shall continuously be maintained in working order. In any case, development of subject property shall preserve or improve the existing pattern of drainage on abutting properties. ZA-02-67 October 31, 2002 Page 4 4. The conditions of approval and ordinance or code provisions of minor design review ZA-02-67 shall be blueprinted on the face of the site plan as part of the plan check submittal package. 5. The applicant shall contact the Planning Division to arrange for a Planning inspection of the site prior to the release of occupancy/utilities. This inspection is to confirm that the conditions of approval and code requirements have been satisfied. Eng. 6. Maintain the public right-of-way in a "wet-down" condition to prevent excessive dust and promptly remove any spillage from the public right-of- way by sweeping or sprinkling. CODE REQUIREMENTS The following list of federal, state and local laws applicable to the project has been compiled by staff for the applicant's reference. Any reference to "City" pertains to the City of Costa Mesa. Ping. 1 . Approval of the Zoning Action is valid for one (1 ) year and will expire at the end of that period unless building permits are obtained and construction commences or the applicant applies for and is granted an extension of time. 2. All contractors and subcontractors must have valid business licenses to do business in the City of Costa Mesa. Final inspections will not be granted until all such licenses have been obtained. 3. Construction, grading, materials delivery, equipment operation or other noise-generating activity shall be limited to between the hours of 7 a.m. and 8 p.m., Monday through Friday, and between the hours of 8 a.m. and 7 p.m. on Saturday, Sunday, and Federal holidays. Exceptions may beomade for activities that will not generate noise audible from off-site, such as painting and other quiet interior work. Bldg. 4. Comply with the requirements of the Uniform Building Code as to design and construction. Fire 5. Provide approved smoke detectors to be installed in accordance with the 1997 Edition of the Uniform Fire Code. Eng. 6. At the time of development submit for approval an off-site plan to the Engineering Division and grading plan to the Building Division that shows sewer, water, existing parkway improvements and the limits of work on the site, both prepared by a civil engineer or architect. Construction access approval must be obtained prior to building or engineering permits being issued by the City of Costa Mesa. Pay off-site plan check fee to the Engineering Division. An approved offsite plan and fee shall be required prior to engineering/utility permits being issued by the City. 7. A site access permit and deposit of $350 for street sweeping will be required by the Engineering Division prior to the start of any on- or off- 2A-02-67 October 31, 2002 Page 5 site work. 8 Submit required cash deposit or surety bond to guarantee construction of offsite street improvements at time of permit per Costa Mesa Municipal Code Section 15-32, and as approved by City engineer. Obtain a permit from the Engineering Division at the time of development and then construct P.C.C. driveway approach per City of Costa Mesa standards as shown on the offsite plan. Location and dimensions are subject to the approval of the Transportation Services Manager. A.D.A. compliance is required for all driveway approaches. 10 Obtain a permit from the Engineering Division, at the time of development and then remove any existing driveways and/or curb depressions that will not be used and replace with full height curb and sidewalk at applicant's expense.
