It is developed with a single-story, single-family residence, a nonconforming single-car garage, and a detached shed in the backyard. The applicant proposes to demolish the single-car garage and shed, construct a detached 2-car garage with a game room and bathroom above, expand the existing residence, and add a second floor to the residence. Proposed is a 7.5 ft. average right (east) side setback for the 2n° floor addition to the single-family residence. There are several 2-story structures in the area with less than an average 10 ft. side setback. It is staff's opinion that the proposed construction would not be obtrusive from on- or off-site because it is only 399 sq. ft. in area and set back approximately 15 feet further from the street than the first floor. All elevations (including the right (east) side) incorporate multiple building planes and breaks in the roof to create visual interest. The right (east) side of the proposed construction incorporates non-viewing windows and overlooks the roof of the adjacent single- story residence. Accessory Building: The proposed 2-story accessory building (game room above garage) does not meet the recommended design guidelines of 10 ft. average side setback and 80% 2nd to 1�' floor ratio. The 2nd floor provides a 5 ft. left (west) side setback and an 88% 2"a to 1�` floor area ratio (405 square feet/462 square feetl. Due to the size, design, and location of the accessory building, staff believes that it will have minimal visual impact on the adjacent property to the left (westl. The second floor at 5 ft. left (west) side setback is only 18 ft. in Iength with one non- viewing, bathroom window. The second floor is also offset from the first floor to create a horizontal plane break for visuai relief. ADMINISTRATIVE ADJUSTMENT The applicant requests an administrative adjustment to encroach 2 ft. into the required left (west) side setback (5 ft. required; 3 ft. proposed) for two columns to support a porte cochere over the driveway. The requested administrative adjustment is for two columns only. Code allows a 2- 'h ft. encroachment into the 5 ft. side setback for roof overhangs. The columns will support an approximately 115 square-foot decorative lattice cover above. The lattice cover complies with Code in terms of setbacks. It is staff's opinion that the proposed architectural element enhances the design of the front elevation and provides visual interest and transition from the first to second floor. The 2 foot encroachment is necessary to provide the code-compliant 10 ft. driveway width. MINOR CONDITIONAL USE PERMIT A minor conditional use permit is required for an incidental residential use that includes a bathroom. Proposed is a game room with a'/z bathroom (toilet and sink only) above a detached, 2-car garage. 392 East 16`" Street April 22, 2004 Page 3 The game room above the detached garage is only 405 square feet with oniy a sink and a toilet. Access to the second floor is from the backyard area directly behind the residence. Staff has included a condition to require elimination of the "storage" area inside the bathroom so that it cannot be easily converted to a bathtub. Staff is also requiring a land use restriction to be recorded against the property to ensure and provide notice that the detached structure may not be converted to a separate dwelling unii. FINDINGS The information presented substantially complies with Section 13-291e) and 13-291g1114) of the Costa Mesa Municipal Code in that: a. The proposed development and use is compatible and harmonious with uses on-site as well as those on the surrounding properiies. The project meets or exceeds ali residential deveiopment standards and intent of design guidelines. b. Safety and compatibility of the design of the buildings, parking areas, landscaping, luminaries, and other site features including functional aspects of the site development such as automobile and pedestrian circulation have been considered. c. The project is consistent with the General Plan. d. The planning application is for a project-specific case and does not establish a precedent for future development. e. The information presented substantially complies with Costa Mesa Municipal Code Section 13-29(g1114) in that the project complies with the City of Costa mesa Zoning Code and meets the purpose and intent of the Residential Design Guidelines, which are intended to promote design excellence in new residential construction, with consideration being given to compatibility with the established residential community. This minor design review includes site planning, preservation of overall open space, landscaping, appearance, mass and scale of structures, location of windows, varied roof forms and roof plane breaks, and any other applicable design features. Both the single-family residence and the accessory structure incorporate plane breaks and other design features to break up the elevations and to provide visual relief. Consideration has also been given to the size, design, and location of the second floor areas to minimize visual and privacy impacts on adjoining properties. f. The intormation presented substantially complies with section 13-29(g1�1) of the Costa Mesa Municipal Code in that special circumstances applicable to the property exist to justify granting of the administrative adjustment 392 East 16`" Street April 22, 2004 Page 4 from side setback requirements (5 ft. required; 3 ft. proposed on the left (west) side) for 2 columns supporting a porte cochere over the driveway. Strict application of the zoning ordinance would deprive the property owner of privileges enjoyed by owners of other property in the vicinity under identical zoning classification. Specificaily, the porte cochere provides visual interest at the front elevation, as suggested by the design guidelines, and the encroachment is necessary to provide the Code compliant driveway width. Granting of the administrative adjustment will not allow a use, density, or intensity, which is not in accordance with the general plan designation for the property. g. The proposed development/use, subject to conditions, is substantially compatible with developments in the same general area. Granting the minor conditional use permit will not be detrimental to the health, safety and general welfare of the public or other properties or improvements within the immediate vicinity. Granting the minor conditional use permit will not allow a use, density or intensity which is not in accordance with the general plan designation for the property. 2. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA1, the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. 3.
