The application has been approved, based on the following project description and findings: PROJECT DESCRIPTION The applicant proposes a first floor expansion and a second story addition to a singie- story, single-family residence. The proposal consists of the addition of two bedrooms and two bathrooms behind the two-car garage and a new rumpus room and master bedroom suite upstairs. ANALYSIS A minor design review is required for a two-story addition that does not comply with all the recommended residential design guidelines to ensure proper design consideration and compatibility with surrounding properties. The proposed construction conforms to all residential developmenY standards and the intent of the residential design guidelines. The second floor area is approximately 36% of the first floor area (896 sq.ft./2,476 sq.ft.) and incorporates architectural articulation such as quoins and shutters to provide decorative contrast on the elevations. Although the second floor average left side setback does not meet the residential design guidelines (10 ft. average recommended; 5 ft. proposed), visual relief is provided through breaks in the elevation utilizing shutters and a roof plant-on. A condition is included to require an eyebrow roof on the left elevation that is consistent with the second floor roofline (rather than a gable). Privacy impacts are minimized since the adjacent residence to the left is single story and has no windows on that side. The second floor is located 20 feet away from the rear and 49 feet away from the right side property lines. A minor modification is also requested to allow a 4-foot encroachment into the front setback (20 feet required; 16 feet proposed) for a window pop out. The plans submitted show the entire room (20 feet wide) encroaching into the front setback. A condition is included to require a redesign of that area for a window pop out only, as shown on the plan as modified by staff. The pop out would provide architectural articulation and interest on the front elevation and would not negatively impact the neighborhood. Since the staircase is not well integrated into the existing floor plan, a condition is also included to require that a land use restriction be recorded against the property to provide notice that the addition may not be used or converted to a second dwelling unit. FINDINGS 1. The information presented substantially complies with Section 13-29(e), 13- 29(g)(6), and 13-29(g)(14) of the Costa Mesa Municipal Code in that: a. The proposed development and use is compatible and harmonious with uses on-site as well as those on the surrounding properties. The proposed construction meets or exceeds all residential development standards and the intent of the residential design guidelines. b. Safety and compatibility of the design of the buildings, parking areas, landscaping, luminaries, and other site features including functional aspects of the site development such as automobile and pedestrian circulation have been considered. c. The project is consistent with the General Plan. d. The planning application is for a project-specific case and does not establish a precedent for future development. e. The 4-foot encroachment for a window pop out will not be materially detrimental to the health, safety and general welfare of persons residing or working within the immediate vicinity of the project or to property and improvements within the neighborhood. f. The 4-foot encroachment for a window pop out is compatible and enhances the architecture and design of the existing and anticipated development in the vicinity. This includes the site planning, appearance, scale of the structure, and any other applicable features relative to a compatible and attractive development. g. The project complies with the City of Costa mesa Zoning Code and meets the purpose and intent of the Residential Design Guidelines, which are ZA-04-99 April 21, 2005 Page 3 intended to promote design excellence in new residential construction, with consideration being given to compatibility with the established residential community. This minor design review includes site planning, preservation of overall open space, landscaping, appearance, mass and scale of structures, location of windows, varied roof forms and roof plane breaks, and any other applicable design features. Although an average 10 ft. left side setback is not provided, visual relief is provided through architectural articulation and a horizontal break in the elevation. The addition will not have any windows that align with adjacent residences. 2. 7he project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. 3. 7he project is exempt from Chapter XII, Article 3 Transportation System Management, of Title 13 of the Costa Mesa Municipal Code. CONpIT10NS OF APPROVAL Ping. 1. Per the approved conceptual plans as modified by staff, the left side elevation shall be revised to provide an eyebrow roof that matches the second floor roofline, the rumpus room window on the left side elevation shall be raised to a minimum of 5 feet above the second floor, the dormers shall be deleted, and only a 4-foot window pop out is permitted at the front elevation. This condition shall be completed under the direction of the Planning staff. 2. A land use restriction, providing notice that the addition shall not be used or converted to a second dwelling unit, executed by and between the applicant and the City of Costa Mesa shall be recorded prior to the issuance of building permits, to inform future property owners of the restriction. Applicant shall submit to the Planning Division a copy of the legal description for the property, and either a lot book report or current title report identifying the current legal property owner so that the document may be prepared. Ping. 3. Street address shall be visible from the public street and may be displayed either on the front door, on the fascia adjacent to the main entrance, or on another prominent location. Address numerals shall be a minimum 6" in height with not less than Yi' stroke and shall contrast sharply with the background. 4. All new and existing construction shall be architecturally compatible with regard to building materials, style, colors, etc. Plans submitted for plan check shall indicate how this will be accomplished. 5. The conditions of approval and ordinance or code provisions of minor design review ZA-04-99 shall be blueprinted on the face of the site plan as part of the plan check submittal package. 6. The applicant shall contact the Planning Division to arrange for a Planning inspection of the site prior to the release of occupancy/utilities. Grading, materials delivery, equipment operation, and other construction-related activity shall be limited to between the hours of 7 a.m. and 8 p.m., Monday through Friday, and 8 a.m. to 6 p.m. Saturday. Construction is prohibited on Sundays and federal holidays. Exceptions may be made for activities that will not generate noise audible from off- site, such as painting and other quiet interior work. Eng. 8. Maintain the public right-of-way in a"wet-down" condition to prevent excessive dust and promptly remove any spillage from the public right-of- way by sweeping or sprinkling.
