Dear Ms. Quiroz:
The purpose of this letter is to advise you of the City's position regarding the above property.
First, thank you very much for your prompt attention to the removal of the outdoor vehicle lift,
stored vehicles, and other debris from the property several months ago.
As stated in the Chief of Code EnforcemenYs letter dated July 20, 2010 (a copy of which is
attached), several buildings on the property have been constructed without building permits. As
noted in the letter, the only permit the City has on file for the property is,from 1956 for a"36 ft. x
64 ft. corrugated steel building". Additionally, the City has no building plans on file. The Chief of
Code Enforcement requested a plan showing the buildings on the property to determine if the
non-permitted structures and/or additions could be legalized through issuance of building permits.
On March 9, 2011, your architect, Mr. Salmi, submitted a plan showing all of the existing buildings
and uses on the property. We have completed our review of the plan and have identifed the
following items that require action:
The 2,377 sp. ft. existinq main service paraqe. This is the original structure built under the
1956 permit. However, the permit does not reference the two full bathrooms on the first and
second floors.
o Repuired ACtion: The second floor bathroom cannot be legalized. Remove the
second floor bathroom.
• The 458 sq. ft. one-storv office addition at the rear of the main sen�ice qaracLe. The City has
no permit for this addition. City air photos show that this structure did not exist prior to 1975.
o Repuired Acfion: The addition cannot be legalized since the site is nonconforming
to the City's floor area ratio (FAR) requirements and must be removed.
• The 634 sp. ft. existinq secondarv qaraqe. The City has no permit for this structure. City air
photos show that the structure did not exist prior to 1984.
o Required Action: This garage can be legalized as long as a building permit is
obtained and it is used for the storage of vehicles only. Recordation of a land use
restriction (LUR) will be required to inform future property owners of this restriction.

The garage
• The 64 S, ft, stora e shed. A building permit is not required for this structure; therefore, there
is no need to obtain approval io legalize it.
o Repuired Action: No action is required for this structure.
• The 6(t, x 5(t. exterior bathroom. The City has no permit for this addition. City air photos
show that the structure did not exist prior to 1984.
o Repuired Action: Remove the exterior bathroom.
Site landscapinq and sidewalk. The properry does not conform to City zoning requirements
for street setback landscaping (10 feet minimum required). Additionally, the existing sidewalk
and driveway approach is asphalt, not concrete.
o Reauired Action: Provide a landscape and irrigation plan, and install landscaping
and irrigation per City Codes. With regard to the sidewalk and driveway approach,
a separate oermit, issued bV the Citv's Public Services Division will be required
because it is within the oublic riqht-of-wav. Please contact the City's Public
Services Department at (714) 754-5323 for additional information.
Because staff has been trying to obtain Code compliance on this property since July 2010, it is
requested that all the above items be corrected no later than 60 days from the date of this letter
(Mav 9, 2011). Once the above items have been corrected, you may contact me to arrange an
inspection qf the property. Failure to compiv will result in the resumption of the issuance of
citations from Code Enforcement. If you have any questions, please do not hesitate to contact me

it appears that the majority of the buildings on your property may have been constructed
without building permits; the only building permit our fifes contain`is for a 2,304 sq.ft.
corrugated steel building. Secause the canopy/carport sovers, hoist, and other
miscellaneous buildings" appear to be used for automotive repair and suppo�t purposes,
it is important that this matter be resolved as soon as possible.
To begin this resolution, you need to contact Senior Planner Mel Lee at either (714)
754-5611 or mlee(a�ci.costa-mesa.ca.us to arrange a meeting with you or your
representative. The City's Building Official or his designee and Mr. Lee, as a
representative from the Planning Division, will meet with you to discuss the matter. Any
information including, but not limited to, plans and building permits for this property,
should be brought to this meeting. Because of the importance of this matter, f would
like 3o establish a deadline of August 14, 2010, for your or your representative to contact
Mr. Lee to begin this process. '

OWNER declares and says, under penalty of perjury, as follows:
OWNER is the true owner of record of that certain real property described herein
and referred to as SUBJECT PROPERTY.
2. OWNER has applied for and obtained from the City of Costa Mesa, a Municipal
corporation, the approval to legalize a detached, 634 square foot garage building
in an MG (General Industrial) zone.
3. The City approved said project but as one of the conditions required recordation
of a Land Use F2estriction to state that the garage shall be used solely for the
parking or storage of motor vehicles.
4. OWNER therefore covenants, agrees, and declares that subject property shall not
be used contrary to the above condition, and he/she shall not permit, allow, or
condone others to so use said properties including his/her tenants, heirs, assigns,
or successors in interest.
5. OWNER hereby grants permission for appropriate City o�cials to enter the
premises from time to time for the purposes of determining compliance with the
conditions and restrictions contained herein. Such inspections shall be conducted
during normal working hours and after reasonable notice to the owner or tenant of
the premises.

6. OWNER intends that this covenant, condition, and restriction shall run with the land
and be binding upon OW NER, his/her heirs, assigns, and successors in interest for
the benefit of the City of Costa Mesa and the adjoining landowners and users and
be a burden on SUBJECT PROPERTY untii terminated by the City of Costa Mesa.
7. This covenant, condition, and restriction may be terminated by recording with the
Office of the Orange County Recorder a Release of Land Use Restriction duly
executed on behalf of the City of Costa Mesa indicating the restriction is no longer
necessary.
8. OWNER further covenants and agrees that he/she shall execute this restriction and
notify any subsequent purchasers or tenants of SUBJECT PROPERTY oi this
restriction and execute all documents necessary to effectuate the intent hereof.
Any use of SUBJECT PROPERTY inconsistent with this restriction may be enjoined
and abated and the owner of the SUBJECT PROPERTY at the time of any
inconsistent use shall be liable for the expenses to the City for the enjoining and
abating, including reasonable attorney fees.
