A RESOLUTION OF THE CITY COUNCIL OF CITY OF COSTA MESA, CALIFORNIA,
ADOPTING INITIAL STUDY/ MITIGATED NEGATIVE DECLARATION FOR THE CODE
AMENDMENT AND THE PROPOSED EMERGENCY SHELTER AT 3175 AIRWAY
AVE
THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES AS
FOLLOWS:
WHEREAS, the City has agreed to partner with Mercy House, a non-profit
organization to provide fifty (50) beds at an emergency bridge shelter to be located on a
parcel at 3175 Airway Avenue in the Industrial Park (MP) zone, pending the proposed
Code Amendment and California Environmental Quality Act (CEQA) compliance; and
WHEREAS, the Municipal Code currently allows the location of emergency
shelters only in the Planned Development Industrial (PDI) zone; and
WHEREAS, the proposed emergency shelter site is zoned Industrial Park (MP)
and has a General Plan Land Use designation of Industrial Park; and
WHEREAS, the General Plan Land Use Element (Page LU-49) states with respect
to the Industrial Park land use designation, "Institutional uses may also be appropriate,
provided that land use compatibility and traffic issues have been addressed. Institutional
uses will require discretionary approval." Therefore, the General Plan anticipates that
institutional uses may be located in the Industrial Park area subject to discretionary
approval; and
WHEREAS, allowing emergency shelters to locate in the MP zone would support
several General Plan goals and policies including, but not limited to, Land Use Element
Objective LU-5A and Housing Element Policy HOU-1.8; and
WHEREAS, allowing emergency shelters to locate in the MP zone would further
support appropriate and compatible land use within the City as well as Safety Element
goals by allowing the City to once again enforce the provisions of the Municipal Code that
regulate camping on public property; and
WHEREAS, the Municipal Code includes Development Standards for Emergency
Shelters in Section 13-200.79 (Special Land Use Regulations) of Title 13, Planning,
Zoning and Development; and

WHEREAS, the Emergency Shelter Development Standards in the Municipal
Code warrant revisions to clarify the intent of the standards and to add a new standard
addressing exterior and adjacent area security; and
WHEREAS, a duly -noticed public hearing was held by the Planning Commission
on August 12, 2019 with all persons provided an opportunity to speak for and against the
proposed project; and
WHEREAS, pursuant to the California Environmental Quality Act (CEQA), an Initial
Study/Mitigated Negative Declaration (IS/MND) including the Mitigation Monitoring and
Reporting Program was prepared in compliance with CEQA and the local environmental
review guidelines; and
WHEREAS, the IS/MND was circulated for the required 30-day public review
period from July 12, 2019 to August 11, 2019; and
WHEREAS, the Planning Commission held a public hearing on August 12, 2019 and
recommended approval of Code Amendment CO-19-01 by a 5-0-2 vote (Commissioners
Colbert and Tourje absent).
WHEREAS, a duly -noticed public hearing was held by the City Council on
September 3, 2019 with all persons provided an opportunity to speak for and against the
proposed project; and,
WHEREAS, written comments received from the general public, government
entities, and other interested parties were responded to, where appropriate, in the manner
prescribed in California Code of Regulations Section 15073; and
WHEREAS, no significant new information has been added to the IS/MND since
its circulation for public comment and no changes to the proposed project have occurred
which would require recirculation of the IS/MND under CEQA Guidelines Section
15073.5; and
WHEREAS, the City Council has reviewed and considered the IS/MND and has
found that the IS/MND adequately evaluates the environmental impacts of the proposed
project, and the IS/MND is complete, adequate, and complies with all requirements of
CEQA, the CEQA Guidelines, and the City of Costa Mesa Environmental Guidelines; and
WHEREAS, the IS/MND reflects the independent judgment and analysis of the City
of Costa Mesa.

NOW, THEREFORE, BE IT RESOLVED that, based on the evidence in the record
and implementation of all the mitigation measures included in the Mitigation Monitoring
and Reporting Program attached as Exhibit A, the City Council hereby adopts the IS/MND
for Code Amendment CO-19-01 and the permanent Bridge Shelter at 3175 Airway Avenue.

Section 21081.6 of the California Environmental Quality Act (CEQA) and Guidelines Section 15097
require a Lead Agency to adopt a mitigation monitoring or reporting program whenever it adopts a
mitigated negative declaration in conjunction with a project approval. The purpose of the monitoring
or reporting program is to ensure compliance with the mitigation measures during project
implementation.
The Initial Study and Mitigated Negative Declaration concluded that the implementation of the
project could result in potentially significant effects on the environment and mitigation measures
were incorporated into the proposed project or are required as a condition of project approval that
reduce these potential impacts to below a level of significance. The purpose of this Mitigation
Monitoring and Reporting Program (MMRP) is to document how and when the mitigation measures
adopted by the lead agency are implemented, and to document that potential environmental
impacts are reduced to less than significant levels as identified in the Mitigated Negative Declaration.
This document does not discuss those subjects that the Mitigated Negative Declaration analysis
demonstrates would result in less than significant impacts and for which no mitigation was proposed
or necessary.
