HomeMy WebLinkAbout19-64 - Establishing Late Penalty & Interest AmountsRESOLUTION NO. 19-64 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ESTABLISHING LATE PENALTY AND INTEREST AMOUNTS PURSUANT TO SECTION 1-33 (VIOLATIONS, PENALTIES AND ENFORCEMENT) OF CHAPTER I (GENERAL) OF TITLE 1 (GENERAL PROVISIONS) OF THE COSTA MESA MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, subsection (f) of Section 1-33 of Chapter I of Title 1 of the Costa Mesa Municipal Code provides that any fee, fine, license fee, tax, or other amount due to the City pursuant to the provisions of the Costa Mesa Municipal Code remaining unpaid the day after the stated due date shall be subject to a late penalty and interest in the amounts established by City Council resolution; and WHEREAS, Section 1-33, subsection (f) further provides that such penalties and interest will not apply to amounts due to the City for which the Costa Mesa Municipal Code expressly designates a specific penalty and/or interest amount; and WHEREAS, the City Council desires to establish the amounts of late penalties and interest for unpaid amounts due to the City pursuant to subsection (f) of Section 1-33. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa as follows: Section 1. Pursuant to subsection (f) of Section 1-33 of the Costa Mesa Municipal Code, any fee, fine, license fee, tax, or other amount due to the City pursuant to the Costa Mesa Municipal Code that remains unpaid on the day after its stated due date shall be subject to a late penalty in the amount of ten percent (10%) of the amount due. Section 2. Pursuant to subsection (f) of Section 1-33 of the Costa Mesa Municipal Code, in addition to a late penalty, any fee, fine, license fee, tax, or other amount due to the City pursuant to the Costa Mesa Municipal Code that remains unpaid on the day after its stated due date shall be subject to interest in the amount of one and one-half percent (1.5%) of the amount due for each month, or any portion thereof, that the amount due remains unpaid.
