Staff supports the encroachment because the encroachment will not be greater than what exists and it is only for 20 additional feet on the first floor; the addition will also maintain the same 8-foot plate height as the existing residence. Furthermore, the addition will be located adjacent to the east neighbor's driveway and garage, minimizing privacy and visual impacts on that neighbor. • The proposed second story satisfies the intent of the Residential Design Guidelines. The second floor is set back at least 7 feet and 12 feet from the east and west (side) property lines, respectively. Various building planes and roof forms are incorporated into the design, providing visual interest and minimizing building mass. The rear setback is proposed at 47 feet, exceeding Code requirement of 20 feet. • Except for one window on the east side of the residence, all other second-story windows will be at least 12 feet from the side property lines. A condition has been included requiring the second-story window that is seven feet from the east property line be non-openable obscure glass or clerestory to minimize privacy impacts to the east neighbor. Therefore, privacy of the adjoining neighbors would not be negatively impacted because of the proposed second-story window locations, setbacks, and design. • Since access to the proposed second floor is not integrated with the main living area, a condition has been included requiring a land use restriction to inform future property owners that the property can only contain one dwelling unit, unless all applicable requirements for a second dwelling unit can be met. • The General Plan designation for the property is Medium Density Residential, which allows a maximum density of one dwelling unit per 3,630 square-foot of lot area. The site contains one dwelling unit on a 6,750 square-foot lot, consistent with both the lot's General Plan and Zoning designations. FINDINGS A. 'The proposed project complies with Costa Mesa Municipal Code Section 13-29 (e) because: 1. The proposed development and use is compatible and harmonious with uses both on-site as well as those on surrounding properties. 2. Safety and compatibility of the design of the buildings, parking areas; landscaping, luminaries, and other site features including functional aspects of the site development such as automobile and pedestrian circulation have been considered. 3. The project is consistent with the General Plan and Zoning designations because the number of dwelling units on the property does not increase. February 14, 2007 OR-06-23 Page 4 4. The planning application is for a project-specific case and does not establish a precedent for future development. B. The information presented complies with Costa Mesa Municipal Code Section 13-29(g)(6) in that the minor modification for a 4-foot, 5-inch east (left) side setback is compatible with the anticipated development in the general vicinity. Granting the minor modification will not be detrimental to the health, safety, and general welfare of the public or other properties or improvements within the immediate vicinity. Specifically, the encroachment will not be greater than what exists and it is only for 20 additional feet on the first floor; the addition will also maintain the same 8-foot plate height as the existing residence. Furthermore, the addition will be located adjacent to the east neighbor's driveway and garage, minimizing privacy and visual impacts on that neighbor. C. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be.exempt from CEQA under Section 15301 for Existing Facilities. D. The project is exempt from Chapter XII, Article 3, Transportation System Management, of Title 13 of the Costa Mesa Municipal Code. CONDITIONS OF APPROVAL Ping. 1. A land use restriction executed by and between the property owner and the City of Costa Mesa shall be recorded prior to the issuance of building permits. This land use restriction shall inform future property owners that the subject property can only contain one dwelling unit with one kitchen, unless all applicable development standards for a second dwelling unit can be met. The applicant shall submit to the Planning Division a copy of the legal description for the property, and either a lot book report or current title report identifying the current legal property owner so that the document may be prepared. 2. The second-story window that is seven feet from the east property line shall be non-openable obscure glass or clerestory to minimize privacy impacts to the east neighbor. An alternative type of window that minimizes privacy impacts to the east neighbor may be permitted under the direction of Planning Staff. 3. All new and existing construction shall be architecturally compatible with regard to building material, style, colors, etc. with the existing residence and detached garage. Plans submitted for plan check shall reflect all above-mentioned revisions and indicate how architectural compatibility will be accomplished. 4. No modification(s) of the approved building elevations including, but not limited to, changes that increase the building height, removal of building • articulation, or a change of the finish material(s), shall be made during February 14, 2007 l) ' DR-06-23 Page 5 construction without prior Planning Division written approval. Failure to obtain prior Planning Division approval of the modification could result in the requirement of the applicant to (re)process the modification through a discretionary review process such as a minor design review or a • variance, or in the requirement to modify the construction to reflect the approved-plans. 5. All construction-related activity shall be limited to between the hours of 7 a.m. and 8 p.m., Monday through Friday, and 8 a.m. to 6 p.m. Saturday. Construction is prohibited on Sundays and federal holidays. Exceptions may be made for activities that will not generate noise audible from off- site, such as painting and other quiet interior work. 6. The conditions of approval, Code requirements, and special district requirements for Development Review DR-06-23 shall be blueprinted on the face of the site plan. 7. The applicant shall contact the Planning Division to arrange for a Planning inspection of the site prior to obtaining a final inspection from Building Safety. This inspection is to confirm that the conditions of approval and code requirements have been satisfied. Eng. 8. Maintain the public right-of-way in a "wet-down" condition to prevent excessive dust and promptly remove any spillage from the public right-of- way by sweeping or sprinkling. CODE REQUIREMENTS The following list of Federal, State, and local laws applicable to the project has been compiled by Staff for the applicant's reference. Any reference to "City" pertains to the City of Costa Mesa. Ping. 1. Approval of the development review is valid for one (1) year and will expire at the end of that period (February 15, 2008) unless building permits are obtained and construction commences, or the applicant applies for and is granted an extension of time. 2. All required setbacks abutting a public right-of-way shall be landscaped, except for walkways and driveways which provide access from the street. The property owner shall be responsible for the maintenance of the landscaping on the property. 3. Existing mature trees shall be retained wherever possible. Should it be necessary to remove existing trees, the applicant shall submit a written request and justification to the Planning Division. A report from a Califomia licensed arborist may be required as part of the justification. Replacement trees shall be of a size consistent with trees to be removed and may be required on a 1:1 basis. This requirement shall be completed under the direction of the Planning Division. 4. Street address shall be displayed on the fascia adjacent to the .main entrance or front door in a manner visible from the public street. Numerals shall be a minimum 6" in height with not less than '/2" stroke and shall February 14, 2007 DR-06-23 Page 6 contrast sharply with the background. 5. Any mechanical equipment such as air-conditioning equipment and ductwork shall be screened from view in a manner approved by the Planning Division. Roof mounted equipment is prohibited. 6. Installation of all utility meters shall be performed in a manner so as to obscure the installation from view from any place on or off the property. The installation shall be in a manner acceptable to the public utility and shall be in the form of a vault, wall cabinet, or wall box under the direction of the Planning Division. Bus. 7.
