Dear Mr. Lamoureux:
Review of the minor conditional use permit for the above -referenced property has been
completed. The application has been denied, based on the following:
BACKGROUND/PROJECT DESCRIPTION:
This towing company (All -In -One Towing, Inc.) has been operating at both 2951 and
2991 Grace Lane without proper City approvals. The business owner (authorized
agent) applied for Minor Conditional Use Permit ZA-04-32 to legalize the towing
business at 2991 Grace Lane; however, the CL (Commercial Limited) zoning of the
property prohibits towing companies with or without storage of motor vehicles. As a
result, the application could not be processed. The property owner was informed to
cease the business and vacate the property by October 15, 2004.
On November 24, 2004, the business owner submitted a minor conditional use permit
application to legalize the towing business and to store up to five vehicles inside the
building at 2951 Grace Lane (the business owner continues to illegally operate his
towing business at 2991 Grace Lane while he waits for Planning's decision for 2951
Grace Lane). On November 29, 2004, Planning Staff sent the business owner a notice
that additional information was required in order for his application to be considered
complete. After no response was received, another letter, dated January 4, 2005, was
sent to the property manager reiterating the need for additional information. A deadline
for submitting the requested information was set for February 4, 2005 and extended
until February 7, 2005.
The deadline has passed and Planning did not receive the requested information to
consider the application complete and evaluate the proposed use. The applicant has
not been able to demonstrate that the proposed use is substantially compatible with the
developments in the same general area and that the proposed use would not be
materially detrimental the health, safety, and general welfare of the public or otherwise
injurious to other properties within the area, as required by Code. Therefore, based on
the lack of findings, the application has been denied.

FINDINGS
A. The information presented does not comply with Costa Mesa Municipal Code section
13-29(g)(2) in that due to the lack of information, findings cannot be made to grant
the minor conditional use permit. Specifically, the applicant has not been able to
demonstrate that the proposed use is substantially compatible with the
developments in the same general area and that the proposed use would not be
materially detrimental the health, safety, and general welfare of the public or
otherwise injurious to other properties within the area.
B. The project has been reviewed for compliance with the California Environmental
Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures,
and has been found to be exempt from CEQA.
C. The project is exempt from Chapter XII, Article 3, Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.
Upon receipt of this letter, your application has been denied. The decision will become
final at 5 p.m. on February 17, 2004, unless appealed by an affected party (including
filing of the necessary application and payment of the appropriate fee) or by a member
of the Planning Commission or City Council.
Unless this application is appealed, the towing and storage of motor vehicles at both
2951 Grace Lane and 2991 Grace Lane shall cease immediately.
