The minor design review for ihe above-referenced project has been completed. The
application has been approved, based on the following project description and
findings, 5ubject to the conditions set forth below:
PROJECT DESCRIPTION
The appliCant requests an administrative adjustment for an 8 ft. encroachment into
the front setback (20 ft. required; 1 2 ft. proposed) for a 1�` floor expansion and a
minor de5ign review for a 2ntl floor addition to a single-family residence. The
proposal Consists of first floor expansion of existing garage and living areas and a
master bedroom suite upstairs. The addition will result in a total of 4 bedrooms
and 4 bathrooms in the house.
ANALYSIS
MINOR DESIGN REVIEW
A minor design review is required for any 2"tl floor addition in the R1 ISingle Family
Residence) zone to ensure proper design consideration and compatibility with
surrounding properties.
The proposal conforms to all development standards and the residential design
guidelines. The 2nd story floor area (including vaulted area above 15 ft. high) is
approximately 50% of the 1s' floor area (1,220 sq. ft./2,421 sq. ft.). The single-

story gable roof height is proposed to be raised above 15 ft. high for a smoother
transition from the 1�` to 2ntl floor. The roof slopes away from the front property
line so as to reduce building mass as viewed from the street. The proposed
construction also incorporates varying rooflines, projections and offsets to provide
an interesting building mass. The 2nd floor area is also positioned to overlook the
roof of the adjacent residence to preserve open-air effect from the neighbor's
backyard.
The proposed 2nd floor addition is well integrated into the 1�` floor configuration.
No privacy impacts are anticipated because the 2nd floor bedroom window will
overlook the roof of the adjacent residence.
ADMINISTRATIVE ADJUSTMENT
The subject site is located within a tract where many of the residences were built
with less than 20 ft. front setbacks. The proposed expansion would be consistent
in design with many of the residences in the area on similar size lots, where one
half of the front elevation projects further towards the street than the other. A
portion of the front elevation is proposed to align with the adjacent residence to the
left (east) at 15 ft. from front property line. A porch roof is proposed to project 3
additional ft. into the front setback (12 ft. front setbackl, which would be in line
with the neighbor's eave overhang.
Based on the design of many homes within the same residential tract, it is staff's
opinion that approval of the administrative adjustment for an 8 ft. front setback
encroachment would not constitute a grant of special privilege and that strict
application of the development standard would deprive such property of privileges
enjoyed by others in the vicinity.
FINDINGS
1. The information presented substantially complies with Section 13-291e) and
13-291g)114) of the Costa Mesa Municipal Code in that:
a. The proposed development and use is compatible and harmonious with
uses on-site as well as those on the surrounding properties. The project
meets or exceeds all residential development standards and intent of
design guidelines.
b. Safety and compatibility of the design of the buildings, parking areas,
landscaping, luminaries, and other site features including functional
aspects of the site development such as automobile and pedestrian
circulation have been considered.

c. The project is consistent with the General Plan.
d. The planning application is for a project-specific case and does not
establish a precedent for future development.
e. The information presented substantially complies with Costa Mesa
Municipal Code Section 13-291g1114) in that the project complies with the
City of Costa Mesa Zoning Code and meets the purpose and intent of the
Residential Design Guidelines, which are intended to promote design
excellence in new residential construction, with consideration being given
to compatibility with the established residential community. This minor
design review includes site planning, preservation of overall open space,
landscaping, appearance, mass and scale of structures, location of
windows, varied roof forms and roof plane breaks, and any other
applicable design features. The visual prominence associated with the
construction of a two-story house or addition in a predominately single-
story neighborhood has been reduced through appropriate transitions
between the first and second floors and the provision of second floor
projections and offsets to avoid unrelieved two-story walls.
f. The information presented substantiaily complies with section 13-29(g)11)
of the Costa Mesa Municipal Code in that special circumstances applicable
to the property exist to justify granting the variance from front setback
requirements (20 ft. required; 12 ft. proposedl. Strict application of the
zoning ordinance would deprive the property owner of privileges enjoyed by
owners of other property in the vicinity under identical zoning classification.
Specifically, the lot is located within a tract where many of the residences
were built with less than 20 ft. front setbacks. The deviation is subject to
such conditions so as to assure that approval of the 8 ft. front setback
encroachment would not constitute a grant of special privilege inconsistent
with the limitations upon other properties in the vicinity and zone in which
the property is situated. Granting the variance will not allow a use, density,
or intensity that is not in accordance with the general plan designation for
the property.
2. The project has been reviewed for compliance with the California Environmental
Quality Act (CEQA�, the CEQA Guidelines, and the City environmental
procedures, and has been found to be exempt from CEQA.
3. The project is exempt from Chapter XII, Article 3 Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.

Approval of the Zoning Action is valid for one (1) year and will expire
at the end of that period unless building permits are obtained or the
applicant applies for and is granted an extension of time.
All contractors and subcontractors must have valid business licenses to
do business in the City of Costa Mesa. Final inspections will not be
granted until all such licenses have been obtained.
Comply with the requirements of the California Code of Regulations,
Title 24, also known as the California Building Standards Code, as
amended by the City of Costa Mesa.
Provide approved smoke detectors to be installed in accordance with the
2001 Edition of the Uniform Fire Code.
At the time of development submit for approval an off-site plan to the
Engineering Division and grading plan to the Building Division that shows
sewer, water, existing parkway improvements and the limits of work on
the site, both prepared by a civil engineer or architect. Construction
access approval must be obtained prior to building or engineering permits
being issued by the City of Costa Mesa. Pay offsite plan check fee to
the Engineering Division. An approved offsite plan and fee shall be

required prior to engineering/utility permits being issued by the City.
6. A construction access permit and deposit of 5350 for street sweeping
will be required by the Engineering Division prior to the start of any on-
or off-site work.
Park 7. Existing parkway tree shall remain.
SPECIAL DISTRICT REQUIREMENTS
The requirements of the following special districts are hereby forwarded to the
applicant:
Sani. 1. Applicant shall pay all current sanitary district sewer connection
charges.
School 2. Pay applicable Newport Mesa Unified School District fees to the
Building Division prior to issuance of building permits.
Upon receipt of this letter, your project has been approved, subject to the above-
listed conditions. A copy of the conceptually-approved site plan is enclosed. The
decision will become final at 5 p.m. on November 13, 2003, unless appealed by an
affected party or a member of the Planning Commission or City Council, including
filing of the necessary application and payment of the appropriate fee.
