After careful consideration of the facts and circumstances, I have determined that the third unit on the property may remain. This determination is based on the unusual circumstances and history surrounding the third unit, the amount of time that has lapsed since the last contact from the City in 1967, and the fact that the 1961 agreement is not being reflected on current title reports, including the title report issued when Ms. Mamishian purchased the property in 1973. It seems clear that Ms. Mamishian purchased the property in good faith, with the understanding that there were three legal units on the lot. Since the zoning of the property changed from R4 to R1 since Variance �584 was issued in 1959, the City will consider the three existing units on the property to constitute a legal, nonconforming use. As such, they may continue in their current use, size and configuration. Any future additions, alterations, expansions or replacement, however, must comply with the ordinances in effect at the time construction is proposed.
