RE: CHANGE OF OCCUANCY AT 638 W.18TH STREET, COSTA MESA
Recently it has come to the attention of the Development Services Department that your
dwelling which is located at 638 W. 18`n street has been modified from a single family
dwelling to a multi-family dwelling (duplex), without approval of the Development
Services Department. Essentially, the occupancy classification has changed from an R-1
(single family dwelling) to R-2 (apartment house). This constitutes a violation of section
111 of the 2010 California Building Code (exhibit A).
A reseazch of our records revealed that a building permit #149 (exhibit B) was issued on
March 19, 1054 for a 296 sq. ft. "living quarters addition". This permit was issued a fina]
inspection approval on June 2, 1958. The pernut inspection record (e�chibit C) and the
activity history sheet (exhibit D) indicate that this permit was issued for an "addition"
versus a secondary dwelling, apartment or duplex. None of the remaining city records
indicate that this permit was issuad for a"secondary dwellin� uniY'. Also, building
permit #149 was issued to the origina] address of 638 W. 18 Street which indicates that
it was not issued to a secondary dwelling unit. If it had, it would have been addressed as
638 W, 18`�' Street #102 or Unit B. If you have any documents in your possession such as
a City approved plan or other permit documents that support this change of occupancy,
please submit them to me and they will be reviewed and considered by staff.
In light of the above, my final determination of this matter is that permit #149 was issued
for an addition and not a secondary dwelling. You are therefore required to restore this
stnxcture back to its original condition which is a single family dwelling with an addition,
within 90 days from the date of this letter. Failure to comply with this order wil] result in
this matter being referred to our Code Enforcement Division for further enforcement
action.
Please be advised that the Board of Appeals process is available to you should wish to
exercise your right to appeal my decision. If you choose to do so, please contact me and I
will assist you through that process.

110.3.4 Frame inspection. Framing inspections shall be
made after [he roof deck or sheathing, all framing,
fireblocking and bracing are in place and pipes, chimneys
and vents to be concealed are complete and the rough eleo-
trical, plumbing, heating wires, pipes and ' ducts are
approved. �
110.3.5 Lath and gypsum board inspection. Lath and
gypsum board inspections shall be made after la[hing and
gypsum board, in[erior and ex[erior, is in place, but before
any plastering is applied or gypsum board joints and fas[en-
ers are taped and finished.
Exception: Gypsum board [hat is not part of a fire-resis-
tance-rated assembly or a shear assembly.
110.3.6 Fire- and smoke-resistant penetrations. Protec-
tion of joints and penetrations in fire-resistance-rated
assemblies, smoke barriers and smoke partitions shall not
be concealed itom view until inspec[ed and approved.
110.3.7 Energy efficiency inspections. lnspections shall
be made [o determine compliance with Chap[er 13 and shal]
include, but not be limited to, inspections for: envelope
insulation R- and U-values, fenes[ration U-value, duct sys-
[em R-value, and HVAC and water-heating equipmen[ effi-
ciency.
110.3.8 Other inspections. In addition to the inspections
specified above, the building official is authorized to make
or require o[her inspections of any construc[ion work to
ascertai� compliance with the provisions of this code and
other laws that aze enforced by [he department of building
safety.
110.3.9 Special inspections. For special inspections, see
Sec[ion 1704. �
110.3.10 Final inspection. The final inspecrion shall be
made after all work required by the building permit is com-
pleted.
110.4 Inspection agencies. The 6uilding official is authonzed
to accept repor[s of approved inspection agencies, provided
such agencies satisfy the requiremen[s as to qualifications and
reliability.
ll0.5 Inspection requests. It shall be the duty of the holder of
[he building pernsit or theu duly authorized agent to no[ify the
buildinb official when work is ready for inspection. lt shal] be
[he duty of the permit holder to provide access [o and means for
inspections of such work [hat are required by this wde.
110.6 Approval required. Work shall not be done beyond the
point indicated in each successive inspec[ion without firs[
obtaining the approval of the building n�cial. The building
��cial, upon notification, shall make [he requested inspec[ions
and shall either indicate the portion of the construction tha[ is
satisfac[ory as completed, or notify the permi� holder or his or
her agent wherein [he same fails to comply wi[h [his code. Any
.. poriions Ihat do not comply shall be corrected and such portion
shall not be covered or concealed un[i] authorized by the build-
ing ojficial.
SECTION 111
CERTIFICATE OF OCCUPANCY
ll11 Use and occupancy. No building or strucmre shall be
used or occupied, and no change in [he existing ocwpancy
classification of a building or strucmre or portion [hereof shal]
be made, until the building o�cia/ has issued a certificate of
occupancy [herefor as provided herein. Issuance of a certifica[e
of occupancy shal] not be construed as an approval of a viola-
tion of the provisions of [his code or of o[her ordinances of [he
jurisdiction.
Exception: Certificates of occupancy are not required for
work exempt from permits under Section 105.2.
1ll.2 Certificate issued. After the building o,fficiu/ inspects
the building or strucmre and finds no violations of the provi-
sions of this code or other laws that are enforced by [he depart-
ment of building safety, [he building o�cial shall issue a
certificate of occupancy [hat contains the following:
L The building permir numbei.
2. The address of the structure.
3. The name and address of the owner.
4. A description of that portion of the structure for which
the certificate is issued.
5. A statement [hat the described portion of [he structure
has been inspected for compliance with the require-
ments of [his code for the occupancy and division of
occupancy and Ihe use for which [he proposed occu-
pancy is classiFied.
6. The name of the building o�cial.
7. The edition of the code under which the permit was
issued.
8. The use and occupancy, in accordance with the provi-
sions of Chapter 3.
9. The type of cons[ruction as defined in �hapter 6.
10. The design occupantload.
11. If an automatic sprinkler system is provided, whether
[he sprinkler system is required.
12. Any special stipulations and conditions of the building
permit.
111.3 Temporary occupancy. The building o�ciul is autho-
rized to issue a temporary certificate of occupancy before the
completion of [he entire work covered by the permit, provided
that such po([ion or poriions shall be ocwpied safely. The
building official shall set a[ime period during which the tempo-
rary certificate of occupancy is valid.
111.4 Revocation. The building offxcial is au[horized to, in
writing, suspend or revoke a certifica[e of occupancy or com-
pletion issued under [he provisions of this code wherever the
ceni£ica[e is issued in error, or on [he basis of incoaect infor-
mation supplied, or where it is determined [hat the building or
structure or ponion thereof is in violation of any ordinance or
regulation or any of the provisions of this code.
