A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, AUTHORIZING THE PUBLIC SERVICES DIRECTOR TO MAKE
APPLICATION FOR, TO SIGN CERTAIN ASSURANCES, AND TO ADMINISTER
GRANT FUNDS WITH RESPECT TO APPLICATIONS FOR LOCAL, STATE AND
FEDERAL PROGRAMS, PROJECT OR GRANTS FUNDED THROUGH THE
VOLKSWAGEN ENVIRONMENTAL MITIGATION TRUST, AND AUTHORIZING THE
CITY MANAGER TO EXECUTE ANY DOCUMENTS AND AGREEMENTS
NECESSARY FOR THE RECEIPT OF THE VEMT FUNDS AND THE PURCHASE OF
ANY VEHICLES USING THE VEMT FUNDS
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, several local, state and federal programs allow public and non-profit
transportation providers to apply for administration, capital, and operation assistance
programs or grants; and
WHEREAS, the Volkswagen Environmental Mitigation Trust (VEMT) provides
about $423 million for California to mitigate the excess nitrogen oxide (NOx) emissions
caused by Volkswagen's use of illegal emissions testing defeat devices in certain
Volkswagen diesel vehicles; and
WHEREAS, the VEMT has $130 million in funds to replace older, high -polluting
transit, school, and shuttle buses with new battery -electric or fuel -cell buses; and
WHEREAS, funds from the VEMT are administered through the San Joaquin
Valley Air Pollution Control District (SJVAPCD) and the California Air Resources Board
(CARB); and
WHEREAS, the City is required to authorize an individual, by resolution, as the
"Authorized Individual" to make application for, to sign required assurances for, and to
administer VEMT funds with respect to applications for local, state and federal programs,
projects or grants.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa
Mesa as follows:
Section 1. The City Council authorizes the Public Services Director to make
application for, to sign required assurances, and to administer the Volkswagen
Resolution No. 2020-43 Page 1 of 3
Environmental Mitigation Trust funds with respect to applications for local, state and
federal programs, projects or grants on behalf of the City.
Section 2. The City Council authorizes the City Manager to execute any
documents and agreements necessary for the receipt of the VEMT funds and the
purchase of any vehicles using the VEMT funds.
