A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, ESTABLISHING FEES FOR USE OF THE CITY'S ELECTRIC VEHICLE
CHARGING STATIONS
THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY FINDS,
DETERMINES, AND DECLARES AS FOLLOWS:
WHEREAS, pursuant to the provisions of the California Constitution and the laws
of the State of California, the City is authorized to adopt and implement rates, fees, and
charges for municipal services; provided, however, that such rates, fees, and/or charges
do not exceed the estimated reasonable cost of providing such services; and
WHEREAS, on September 1, 2020, the City Council awarded a contract to AMTEK
Construction for the installation of four (4) dual port Level 2 electric vehicle (EV) charging
stations and one (1) DC Fast Level 3 EV charging station at City Hall; and
WHEREAS, a Level 2 EV charging station charges an electric vehicle in
approximately three (3) to eight (8) hours, depending on the vehicle, and a DC Fast Level
3 EV charging station charges a vehicle in approximately twenty (20) minutes to one (1)
hour; and
WHEREAS, City staff conducted a fee study to determine optimal pricing in order
for the City to recover operating expenses for the public EV charging infrastructure; and
WHEREAS, based upon the fee study, staff is proposing to establish a fee of
Twenty -Eight Cents ($0.28) per kilowatt hour (kWh) for use of the City's Level 2 EV
charging stations for the first four (4) hours, escalating to Five Dollars ($5.00) per hour
after four (4) hours, and a fee of Thirty -Eight Cents ($0.38) per kilowatt hour (kWh) for
use of the City's DC Fast Level 3 EV charging station for the first two (2) hours, escalating
to Five Dollars ($5.00) per hour after two (2) hours; and
WHEREAS, the increased fee of Five Dollars ($5.00) per hour after four (4) hours
on the Level 2 EV charging stations and after two (2) hours on the DC Fast Level 3
charging stations is intended both to discourage drivers from leaving their vehicles
plugged in beyond the time necessary to charge their vehicles and to also serve as a cost
recovery mechanism, enabling the City to recover its costs for charging services that
exceed the initial timeframes specified; and

WHEREAS, the City Council desires to establish the amount of the fees for use of
the City's EV charging stations as proposed by City staff; and
WHEREAS, the proposed fees will allow the City to recover the reasonable costs
incurred by the City for electricity costs and maintenance costs in connection with the EV
charging station infrastructure and will not exceed the reasonable costs of providing EV
charging services; and
WHEREAS, the City Council conducted a duly noticed public hearing at its regular
meeting on November 10, 2020 to consider the proposed fees for use of the City's EV
charging stations; and
WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF COSTA MESA AS FOLLOWS:
Section 1. The City Council hereby finds and determines, based upon the data,
information, analysis, and oral and written documentation presented to the City Council
concerning the proposed fees for use of the City's electric vehicle (EV) charging stations,
that the proposed fees do not exceed the reasonable costs of providing EV charging
station services.
Section 2. The fees for using the City's electric vehicle (EV) charging stations
shall be as follows:
a. Level 2 EV Charging Stations: Twenty -Eight Cents ($0.28) per kilowatt hour
(kWh) for the first four (4) hours, escalating to Five Dollars ($5.00) per hour
after four (4) hours.
b. DC Fast Level 3 EV Charging Station: Thirty -Eight Cents ($0.38) per
kilowatt hour (kWh) for the first two (2) hours, escalating to Five Dollars
($5.00) per hour after two (2) hours.
Section 3. The City Clerk shall certify to the passage and adoption of this
Resolution and shall enter it into the book of original resolutions.
