CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA,
AMENDING SECTIONS 5-1, 5-1.1 AND 5-1.3 AND ADDING SECTION
5-1.4 OF CHAPTER I OF TITLE 5 AND SECTIONS 7-14 AND 7-15 OF
CHAPTER II OF TITLE 7 OF THE COSTA MESA MUNICIPAL CODE
BY ADOPTING THE 2019 EDITIONS OF THE CALIFORNIA BUILDING,
CONSTRUCTION AND FIRE CODES AND RELATED MODEL CODES
WITH APPENDICES AND AMENDMENTS THERETO, AND
REPEALING THE ADOPTION OF THE 2016 EDITIONS OF THE
CALIFORNIA CODES AND AMENDMENTS THERETO, AND
ADOPTING THE ORANGE COUNTY GRADING AND EXCAVATION
CODE WITH AMENDMENTS THERETO, WITH THE EFFECTIVE DATE

SUMMARY:
The California Health and Safety Code requires local governments to adopt the most recent
editions of the model codes related to construction. The construction codes include the
California Building, Residential, Green Building Standards, Fire, Plumbing, Mechanical, and
Electrical Codes. If the City Council adopts Ordinance 19-18, the most recent editions of the
California construction codes with the applicable amendments will become effective January
1, 2020, as required by State law.
RECOMMENDATIONS:
1. Give second reading to and introduce Ordinance 19-18, to be read by title only, and
further reading waived, for the 2019 Edition of the Model California Construction

Codes. This procedure is in accordance with the California Government Code Title
5, Division 1, Part 1, as published by the Building Standards Bulletin 19-05.
BACKGROUND:
California Health and Safety Code section 17958 mandates that the California Building
Standards Commission adopt and publish the California Building Standards Code (Title
24 California Code of Regulations) every three years. The 2019 Edition of the California
Code of Regulations Title 24, which incorporates the state model codes, becomes
effective on January 1, 2020. If adopted, Ordinance 19-18 will amend Titles 5 and 7 of
the Costa Mesa Municipal Codes by repealing references to the prior editions of the model
codes and make various amendments based on local conditions to the model codes.
On November 5, 2019 City Council gave first reading to and introduced Ordinance 19-18 by
a 7-0 vote. See November 5, 2019 City Council Agenda Report. If adopted, Ordinance 19-
18 will adopt the 2019 California Building Codes with amendments.

FISCAL REVIEW
The adoption of the proposed Codes will not have any fiscal impact on the City’s budget.
CITY COUNCIL GOALS & PRIORITIES:
The proposed adoption of the 2019 editions of the California construction codes, including
the applicable amendments would, in general, address City Council Goal 1: Keep our
Community Safe, as the implementation of current, state-of-the-art construction codes will
ensure development in Costa Mesa follows the safest, most current practices.
LEGAL REVIEW
The City Attorney’s Office has reviewed this report and the attached ordinance and
approves them as to form.
ALTERNATIVES CONSIDERED
City Council may adopt the model codes with the amendments recommended by Staff
with or without modifications. If the City Council does not adopt the model codes, then
by default the 2019 model codes will take effect on January 1, 2020.
CONCLUSION
If the City Council adopts the attached resolution and ordinance, the 2019 editions of the
California construction codes, including the applicable amendments, will become effective
January 1, 2020 within the City of Costa Mesa as required by State law. If the City does not

adopt the amendments and make the specified findings or otherwise fails to act, the model
codes (without amendments) will become effective January 1, 2020 as a matter of law.
