HomeMy WebLinkAbout11 - CC-12 - Update State of California- CAL OES - 1/19/2021 CITY COUNCIL AGENDA REPORT MEETING DATE: JANUARY 19, 2021 ITEM NUMBER: CC-12 SUBJECT: UPDATE STATE OF CALIFORNIA, GOVERNOR’S OFFICE OF EMERGENCY SERVICES (CAL OES) DESIGNATION OF APPLICANT’S AGENT RESOLUTIONS DATE: JANUARY 4, 2021 FROM: POLICE DEPARTMENT PRESENTATION BY: JASON DEMPSEY, EMERGENCY SERVICES ADMINISTRATOR FOR FURTHER INFORMATION CONTACT: JASON DEMPSEY (714) 754-5333 RECOMMENDATION: Staff recommends City Council: 1. Approve and adopt the State of California, Governor’s Office of Emergency Services (Cal OES) Designation of Applicant’s Agent Resolutions (Attachments 1 & 2). 2. Authorize submittal of the approved Designation of Applicant’s Agent Resolution Forms to the State. BACKGROUND: The Cal OES Designation of Applicant’s Agent Resolution (Cal OES Form 130) designates the agents authorized to submit applications for the purpose of obtaining federal financial assistance, under the Robert T. Stafford Disaster Relief and Emergency Assistance Act, and/or state financial assistance under the California Disaster Assistance Act. The designated agents are also authorized to act on Costa Mesa’s behalf to provide to Cal OES all assurances and agreements related to such financial assistance. ANALYSIS: A Designation of Applicant’s Agent Resolution for Non-State Agencies (Cal OES Form 130) is required of all applicants to be eligible to receive state funding. The Emergency Management Performance Grant (EMPG) updated its requirement for a Designation of Applicant’s Agent Resolution to be completed annually to every three years. The current resolution is due to expire in February 2021. For 2021, EMPG program provided both a 2 Designation of Applicant’s Agent Resolution (Cal OES Form 130 – Attachment 1) that will be used for all other grants and reimbursements from the State of California and an updated resolution template that is specific for EMPG (Attachment 2). Both versions of the Designation of Applicant’s Agent Resolution will be needed to maintain eligibility for all state and federal emergency management and related grants. ALTERNATIVES CONSIDERED: The City Council may opt not to approve the Designation of Applicant’s Agent Resolutions. This would make Costa Mesa ineligible for emergency management grants and disaster recovery reimbursement from the State of California. It also would prevent the City from utilizing funding from grants currently in use, such as the Emergency Management Performance Grant (EMPG) and the Hazard Mitigation Program Grant (HMPG). FISCAL REVIEW: No fiscal impact. LEGAL REVIEW: The City Attorney’s Office has reviewed and approved these documents as to form. CITY COUNCIL GOALS & PRIORITIES: This item supports City Council Goal 1, Keep our Community Safe. CONCLUSION: Staff recommends that the City Council to: 1. When completing the Cal OES Form 130, Subrecipients should fill in the blanks on page 1. The blanks are to be filled in as follows: Resolution Section: Governing Body: This is the individual or group responsible for appointing and approving the Authorized Agents. Examples include: Board of Directors, City Council, Board of Supervisors, etc. Name of Subrecipient: This is the official name of the non-profit, agency, city, county or special district that has applied for the grant. Examples include: City of Sacramento; Sacramento County; or Los Angeles Unified School District. Authorized Agent: These are the individuals that are authorized by the Governing Body to engage with the Federal Emergency Management Agency and the California Governor’s Office of Emergency Service regarding grants applied for by the subrecipient. There are two ways of completing this section: 1. Titles Only: If the Governing Body so chooses, the titles of the Authorized Agents should be entered here, not their names. This allows the document to remain valid if an Authorized Agent leaves the position and is replaced by another individual. If “Titles Only” is the chosen method, this document must be accompanied by a cover letter naming the Authorized Agents by name and title. This cover letter can be completed by any authorized person within the agency (e.g.; City Clerk, the Authorized Agent, Secretary to the Director) and does not require the Governing Body’s signature. 2. Names and Titles: If the Governing Body so chooses, the names and titles of the Authorized Agents should be listed. A new Cal OES Form 130 will be required if any of the Authorized Agents are replaced, leave the position listed on the document or their title changes. Governing Body Representative: These are the names and titles of the approving board members. Examples include: Chairman of the Board, Superintendent, etc. The names and titles cannot be one of the designated Authorized Agents. Certification Section: Name and Title: This is the individual that was in attendance and recorded the Resolution creation and approval. Examples include: City Clerk, Secretary to the Board of Directors, County Clerk, etc. This person cannot be one of the designated Authorized Agents to eliminate “Self Certification.” Cal OES 130 (Rev.03/28/17 Page 2 Governing Body Resolution BE IT RESOLVED BY THE City Council (Governing Body) OF THE THAT (Name of Applicant) , OR (Name or Title of Authorized Agent) , OR (Name or Title of Authorized Agent) , (Name or Title of Authorized Agent) is hereby authorized to execute for and on behalf of the named Applicant, a public entity established under the laws of the State of California, any actions necessary for the purpose of obtaining federal financial assistance provided by the federal Department of Homeland Security and subgranted through the State of California for the following Grant Award: (List Grant Year and Program) Passed and approved this day of , 20 Certification I, , duly appointed and (Name) Of the (Title) (Governing Body) do hereby certify that the above is a true and correct copy of a resolution passed and approved by the day of ,20 (Official Position) (Signature) (Date) City of Costa Mesa City Manager Director of Finance Emergency Services Administrator EMPG 2020, EMPG 2021, EMPG 2022 19th January 21 Brenda Green City Clerk City of Costa Mesa 19th January 21 City Clerk Attachment 2
