CITY COUNCIL AGENDA REPORT
MEETING DATE: APRIL 6, 2021 ITEM NUMBER: CC-7
SUBJECT: ACCEPTANCE AND ALLOCATION OF THE 2020 EDWARD
BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG)
FUNDS
DATE: MARCH 16, 2021
FROM: POLICE DEPARTMENT
PRESENTATION BY: ROXI FYAD, PUBLIC AFFAIRS MANAGER
FOR FURTHER INFORMATION CONTACT: ROXI FYAD, 714-754-5282
RECOMMENDATION:
Staff recommends City Council:
1. Approve the proposed resolution (Attachment 1) authorizing acceptance of the 2020
Edward Byrne Memorial Justice Assistance Grant (JAG) funds and authorize the City
Manager to execute the Memorandum of Understanding (MOU) with the County of
Orange (Attachment 2) and the Certifications and Assurances (Attachment 3) for the
2020 Edward Byrne Memorial JAG.
2. Accept $20,928.43 in JAG funds and appropriate funding in the Police Department
budget for the specified purpose.
BACKGROUND:
The Edward Byrne Memorial Justice Assistance Grant (JAG) is a major source of federal
criminal justice funding to states and local governments. The JAG provides states and
local governments with funding needed to support criminal justice related activities, such
as law enforcement; prosecution and court; prevention and education; corrections and
community corrections; drug treatment and enforcement; planning, evaluation, and
technology improvement; crime victim and witness; and mental health programs. A local
JAG award is typically required to be shared by the county and one or more jurisdictions
identified by the US Department of Justice (DOJ) as “disparate” within the current fiscal
year eligibility list.
The County of Orange (“County”) serves as the lead fiscal agent for Orange County, and
submits a single application representing the interests of itself and ten other units of local
government that are eligible to receive a funding allocation, including Costa Mesa. As the
lead fiscal agent, the County is also responsible for administration of funds allocated and
ensuring compliance with JAG requirements. Each year, prior to submitting the
2
application to the DOJ, the County reaches out to the eligible local law enforcement
agencies to solicit projects.
The City of Costa Mesa has participated in the JAG (formerly the Local Law Enforcement
Block Grant, LLEBG) since 1996. The funds have enabled the Police Department to
acquire needed equipment and technology in support of organizational initiatives.
ANALYSIS:
The County of Orange was awarded $365,643.00 for the 2020 JAG, which is allocated
across eligible Orange County agencies. Each agency’s funding allocation is based on
the level of Part 1 violent crimes reported to the Federal Bureau of Investigation (FBI)
over a three-year period. The City of Costa Mesa’s 2020 JAG allocation is $23,973.00;
however, the County retains a 10% administrative fee of $2,397.30 and National Incident-
Based Reporting System (NIBRS) fee of $647.27, leaving the City’s remaining allocation
at $21,697.20. There are no City matching requirements for acceptance of this grant. The
grant period for the FY 2020 award is October 1, 2019 through September 30, 2023.
Per the JAG requirements, the funds may be used to provide additional personnel,
equipment, supplies, contractual support, training, technical assistance, and information
systems for criminal justice. In November 2020, the Department was required to submit
a project narrative to the County for the allocated funds. The Department identified the
need to support community engagement, interaction, and partnerships through Public
Affairs and Crime Prevention community outreach and engagement efforts that include
Neighborhood Watch, public service announcements, social media engagement, and
community events.
The Public Affairs Unit of the Police Department is committed to community engagement
initiatives that build upon and enhance the department’s rapport with the community of
Costa Mesa. The Department can more effectively communicate to its audience with a
media room equipped to create effective videos, social media campaigns, and public service
announcements that will benefit and inform the public. The primary duties of the Crime
Prevention Unit is to reach out, engage, and build partnerships with the Costa Mesa
community. The Department seeks sufficient materials and crime prevention items for the
community outreach it can undertake.
The proposed media equipment and outreach materials would allow the department to build
upon and enhance the community’s safety by communicating to its residents via
professional video and media, and making outreach more effective by providing the
community crime prevention materials. This can have a positive impact on the community
partnerships and helps foster goodwill with residents.
ALTERNATIVES CONSIDERED:
The alternative consideration is not to accept the grant; however, the Department does
not recommend this alternative because alternative funding sources, such as the City’s
General Fund, would need to be used to purchase the media equipment and outreach
materials needed to enhance community outreach.
