Hello everyone,
Glad to see the City back in full- force since pre-covid 2020
This is in regard to Ordinance No. 2021-09 :
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA
AMENDING SECTION 9-29.5 OF ARTICLE 5 (ADMINISTRATION, APPLICATION AND
PROCEDURES) OF CHAPTER I (BUSINESS TAX) AND SECTIONS 9-116, 9-119, 9-120 & 9-121 OF
CHAPTER II (REGULATION OF CERTAIN BUSINESSES) AND CHAPTER VI (MARIJUANA
BUSINESS PERMITS) OF TITLE 9 (LICENSES AND BUSINESS REGULATIONS) TO ESTABLISH THE
TAX RATE, OPERATING REQUIREMENTS AND STANDARDS FOR CANNABIS USES, INCLUDING
RETAIL, CANNABIS STOREFRONT AND NON -STOREFRONT USES TO IMPLEMENT THE CITY OF
COSTA MESA RETAIL CANNABIS TAX AND REGULATION MEASURE (MEASURE Q)
As you can probably imagine how competitive it must be to find an appropriate real estate that abides by all the zoning
requirements, we feel that Section 12- 200.93(e)(6), where it prohibits a permit to be issued to a property where an
illegal dispensary once had occupied (since 1 year of last occupancy) makes it even more difficult for an applicant to
secure a location. We feel that applicants who are making an effort to apply for a City permit to operate legally for a
retail storefront should not be 'penalized' because of the previous actions of individuals/entities that had decided to
once operate illegally at these premises.
Would it be possible to consider making amends to this proposal where the application/applicant can still be approved
and the permit will be on hold until 1 year has passed from the last date of occupancy of the illegal operation? Or/and,
the applicant also should not be the same entity/Owner of a previous establishment that once had been enforced to
shut -down by the City. The Owner(s) of the property shall still pay any outstanding balances due from the previous.
We feel that this will give entrepreneurs like myself a 'fighting chance' of winning a City permit against big
conglomerates that have already been taking over this industry.
Kind Regards,
Jason Park
