HomeMy WebLinkAbout07 - CC-6 - 2020 Annual Review of the Costa Mesa - 7/20/20211 CITY COUNCIL AGENDA REPORT MEETING DATE: JULY 20, 2021 ITEM NUMBER: CC-6 SUBJECT: 2020 ANNUAL REVIEW OF THE COSTA MESA 2015-2035 GENERAL PLAN DATE: JULY 8, 2021 FROM: ECONOMIC AND DEVELOPMENT SERVICES DEPARTMENT/PLANNING DIVISION PRESENTATION BY: JUSTIN ARIOS, ASSISTANT PLANNER FOR FURTHER INFORMATION CONTACT: JUSTIN ARIOS (714) 754-5567 justin.arios@costamesaca.gov RECOMMENDATION: Staff recommends that the City Council approve of the 2020 Annual Review of the 2015- 2035 Costa Mesa General Plan as its annual progress report for final submittal to the State Office of Planning and Research and the State Department of Housing and Community Development. BACKGROUND / ANALYSIS: The Land Use and Zoning Law, Government Code section 65000 et seq., requires that an annual progress report (APR) from the City’s legislative body be submitted to the State agencies identified above. Government Code section 65400 requires that an APR be made to the City’s legislative body (City Council) on the status of the General Plan and progress in its implementation for the calendar year, including progress toward meeting its Housing Element goals and its Regional Housing Needs Allocation (RHNA). In addition, the State has updated its forms and instructions to incorporate new APR requirements, pursuant to Assembly Bill 879 (2017), Senate Bill 35 (2017), Assembly Bill 1486 (2019), Assembly Bill 101 (2019), Assembly Bill 1255 (2020) and Assembly Bill 83 (2020). The APR data is used by HCD to determine whether a jurisdiction has made sufficient progress toward meeting its RHNA. Jurisdictions which have not built their pro-rata share of the RHNA within specific income categories would be subject to streamlining process of SB 35, which would allow housing projects that provide 10% affordable units by right (i.e., without discretionary local review). The City is currently in good standing for meeting its RHNA allocation and is subject to by-right development under SB 35 only if the project includes 50% affordability. 2 At its April 26, 2021 meeting, the Planning Commission reviewed and recommended approval of the annual report, and requested that staff provide additional details in the areas where implementation was described as “ongoing.” Staff have modified the annual report to provide those details. The link to the Planning Commission staff report and meeting video are provided below. The 2020 Annual Report is provided as Attachment 1 and consists of:  Table 1 (Annual Review Summary) which describes the status of the 2015-2035 General Plan goals, objectives, and policies and progress in 2020 toward implementing the City’s long range plan for land use and development.  Attachment 1 (Annual Progress Report Forms) provides the City’s progress in meeting its share of the RHNA, pursuant to State Government Code Section 65584 and local efforts to remove governmental constraints to the maintenance, improvement, and development of housing.  Appendix A (General Plan Goals, Objectives, Policies)  Appendix B (FY 19/20 Housing Successor Annual Report) Overall, the report demonstrates that the City has made steady progress in implementing its General Plan goals and policies in 2020. Regarding the 2014 – 2021 Housing Element, the report demonstrates that the City has met its RHNA allocation for this planning period. With a RHNA allocation of two lower-income units (one very-low and one low-income), the City has reported a total of 1,172 new housing units since 2014, for this Housing Element 3 cycle (2014 – 2021). Of those, 38 are reported in one of the affordable unit categories. Nine units are deed-restricted very-low income units associated with the approved project at the former Costa Mesa Motor Inn site (2277 Harbor Boulevard); the remaining 29 are accessory dwelling units (ADU’s) constructed since 2018 (4 ADU’s are reported in the very low income category, 17 ADU’s are reported in the low income category and 8 ADU’s are reported in the moderate income category). PUBLIC NOTICE: There is no public notice requirement for approval of the Annual Report. ENVIRONMENTAL DETERMINATION: The Annual Report of the 2015-2035 Costa Mesa General Plan is not subject to the provisions of the California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15378(b)(2), as this report and review is not a project as defined by this section. ALTERNATIVES CONSIDERED: 1. Modify the 2020 Annual Review of the 2015-2035 Costa Mesa General Plan. The City Council may modify the 2020 Annual Review of the 2015-2035 Costa Mesa General Plan. FISCAL REVIEW: There is no fiscal impact to the City. LEGAL REVIEW: The City Attorney’s Office has reviewed this Agenda Report and the attached 2020 Annual Report and approves them both as to form. CITY COUNCIL GOALS & PRIORITIES: Goal 5: Diversify, stabilize and increase housing to reflect community needs. CONCLUSION: As required by the Government Code, the 2020 Annual Report provides a status of the City’s General Plan and the City’s progress in its implementation for the calendar year (including progress toward Housing Element goals and regional housing needs). Following City Council approval, the final annual report will be submitted to the State Office of Planning and Research and the State Department of Housing and Community Development. 4 _________________________________ _________________________________ JUSTIN ARIOS JENNIFER LE Associate Planner Director of Economic and Development Services ________________________________ _________________________________ CAROL MOLINA KIMBERLY HALL BARLOW Finance Director City Attorney Attachment: 1. 2020 Annual Report
