HomeMy WebLinkAbout14-04 - Cost Recovery for Excessive Use of Police Services1 1 1 RESOLUTION NO. 14-04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CERTIFYING THE INVOICE PERIOD AND COST RECOVERY AMOUNT FOR EXCESSIVE USE OF POLICE SERVICES UNDER CHAPTER VI OF TITLE 14 OF THE COSTA MESA MUNICIPAL CODE. WHEREAS, the City Council of the City of Costa Mesa has adopted Ordinance No. 14-01, adding Chapter VI (Cost Recovery for Excessive Use of Resources Due to Nuisance Activities) of Title 14 (Police and Law Enforcement) of the Costa Mesa Municipal Code, which authorizes the issuance of cost recovery amounts upon lodging establishments who exceed their allotted calls for service, as defined by Section 14- 81(x) of the Costa Mesa Municipal Code; and WHEREAS, Section 14-81(x) provides that the invoice period be set by City Council resolution; and WHEREAS, Section 14-87 provides that the cost recovery amount for police calls for service that exceed the allotted threshold be set by City Council resolution; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa, California, as follows: 1. The cost recovery amount per call for service for nuisance activity exceeding the lodging establishments' allotted nuisance activity calls for service shall be set at $360.00 per call, pursuant to Exhibit A, attached herewith and incorporated by this reference. 2. Lodging establishments will be invoiced on a quarterly basis. 3. The cost recovery amount and invoice period shall remain in force until changed by a new resolution. BRENDA GRE N, CITY CLERK Resolution No. 14-04 Page 2 of 2 os Me' sa EXHIBIT A COST RECOVERY AMOUNT DETERMINATION FOR EXCESSIVE USE OF POLICE SERVICES UNDER CHAPTER VI OF TITLE 14 OF THE COSTA MESA MUNICIPAL CODE Each lodging establishment will be charged $360.00 for each call for service for nuisance activity occurring at that establishment, as defined by Section 14-81(r) of the Costa Mesa Municipal Code, that exceeds the allotted threshold for that establishment. The cost recovery amount.of $360.00 per service call is calculated as follows: This amount is calculated by dividing the total police department budget (FY 2013-14 = $40,248,392.00) by the average number of annual calls for service after removing patrol checks and 911 and wireless 911 calls that were unnecessary to log, unfounded, or cancelled (approximately 78,200). Using this methodology will yield a cost recovery of approximately $515.00 per call. This amount, $515.00, is then offset by 30% in order to counteract charges for services not likely attributed .to lodging establishment enforcement. Therefore, the amount per call above the allotted threshold comes out to be $360.00. .
