After meeting with Mr. Richard Hanhart, Mrs. Carl Stevens and you,
at the Buildir.g Department office in Costa Mesa, I feel that our
position is pretty clear at this point. We are willing to help�
you solve your problem by allowing you access or giving you an
easement across the north end of our property to alleviate your
drainage problems. I believe that the Building Department made
it clear that it is your responsibility to take care qf the work
and that there are approximately three alternatives to solve the
problems. 1t.�o of them require drainage across our property in
some type of fashion, either underground or surface, however, I
am going to repeat the co�ent made in a previous letter "once
we have paved our parking I.ot in the back you will no longer be
able to underground your drainage at the north end of our property"

We must advise you that the City does not have an
ordinance covering drainage from private property and

By way of introduction, I am Carl R. Stevens, the property owner
at 765 Newton Way, Costa Mesa, Ca., one of the parcels behind the
property you are presently improving at 750 W, 17th St.,Costa Mesa,Ca,
Upon a recent inspection o£ my property, I became aware of a
potential problem which could cause substantial damages to surrounding
parcels and improvements. It was not imme@iately apparent to me that
any provisions had been made to a1Tow the water, which has historically
drained across the rear of your pToperty , to continue. Since we aTe
now into the rainy season, I would appreciate it if you would please
advise me within the next 15 days of the plans you have made to provide
for this drainage.
The next heavy rain could cause flooding of the surrounding
progerties i£ the run-off is not allowed to follow its normal course
along the rear of our properties.:;-. ...
An additional potential problem could be the creation of a
stagnant body of water of.substantial depth as to be an attractive
nuisance to the children in the surrounding areas, thus possibly
endangering not only progerties, but individuals as we1T.
Continued obstruction of the drainage course wi11 require that a
determination o£ liability be made by the appropriate officials.
It is my concern that all of our properties be protected from
future injury, and that we can eliminate these problema before any
damages or accidents occur,

Carl Stevens developed the property at 765 tiewton Way and, in the
process, permi.tted water from the Johnson's property to flow across the
rear of the Stevens property. This water, in m� opinion appears to belong
to rlrs. Stevens and t•;rs. Sohnson and it would seem to be their responsibilit�
since, in developed areas, I have heard, caater. is a common enemy and can be
fended off by a developer, such as is happening here.
S:nce the City has no- drain2ge ordinance and our only develooment
policy eow is to require that each developer take care of his own coater,
I see this drainsge problem as a private matter betcaeen property own�rs.
P.S. The developer at 750 West 17th Street has, in construction operations,
dumped a small amount of eartn on Plrs. Stevens oroperty and we taill tell
hin he had better remove this, though'. we do not have legal jurisdiction
when n�ighSoring property is da�-aaged.
P.S.S. An illegal paint spraj booth was also noted at the rear of .•:rs.
Stevezs property. This will havz to oe remeved or leg.lized som��ho:a.

Dear Mr. Stevens:
Thank you for your letter of October 31, 1977. We have not taken
any precautions regarding the drainage of your property as we were
not aware of any cross lot drainage easements or requirements on the
north part of our property. We have proceeded to handl.e our drazn-
age problems with the City of Costa Mesa by tying into an existing
easement at the northeast corner of our property. We had discussed
our drainage problems with the City of Costa Mesa and were instructed
to wor.k out any storm drain problems with our down stream neighbors
as far as draining our property.
Since �e do not wish to create an unsurmontable problem for you, we
are willing to allow you access and give you reasonable easements
�� to drain across the north end of our property provided that you per-
form the work. We would only stipulate that this work be completed,
whether it is an underground structure or pump station, before we
pave the north portion of our property. If you have not taken rare
of your drainage problem by that date we will be forced by our con-
strixction schedule to pave out that ar.ea (which will occur in
approximately 30 days)that is designated as a parking lot, and you
will then have to seek other alternatives to take care of your drainage.
We look forward.to'assisting you in whatever way we can.

Mrs. Carol Stevens was in to see me on January 11, 1978 about a
recurring drainage problem on her above rental property.
She says when they built their improvements about 6-7 years ago
the City required them to drain their property to Newton Way but
that they could not interfere with "natural drainage" across the
back of their parcel. The natural flow is such that almost�all
adjoining properties drain across the back of their parcel.
Now, City has allowed Nelson to develop his property on 17th (in
back of their parcel) and put in a block wall and drain his parcel
to nearby storm drain. His grade level will be about four feet
higher than theirs.
The result is --.backup and ponding of all the water from the
surrounding area now flows across and down their parcel to Newton Way
-- causes floodinq and mud in their buildings on parcel.
Though she "intimated" that City might be NEGLIGENT in what it has
done here, she is primarily concerned with protecting their parcel.
Says she has,discussed this with you, County Flood Control o£ficials,
etc. Believes she has two alternatives:
1.• Pipe and drain in back of Nelson's parcels to same storm
drain he is tying into at their expense and maintenance.
2. Put up block wall to stop other parcel's drainage across
their land (much cheaper).
Says you have advised her both of these methods are acceptable.
Told her I would have to check into facts and it may be thateher
problems are primarily with adjacent owners and not City.
, Would appreciate your advising me of your version of this situation
so I can see if City is exposed to liability or are we merely talking
about problems between adjacent landowners. We MAY have exposure to

FACTS
You have raised the question of whether the design of the Victoria
Street widening project (A.H.F.P. Project 870), and particularly the
sur�ace coater drainage features thereof, will result in an unreascnable
risk of legal�liability to the City.
; You indicate that, at present, approximately 15 acres of run-off water
� from developed and undeveloped land drains onto Victoria Street. The
run-off is carried from Canyon Drive to the west along Victoria Street.
Ultimately, it is disposed of through existing aspnalt concrete s:aales
along the shoul3ers of Victoria Street into existing ponds and undevel-
oped land ocaned by State Mutual Savings and Loan Association north
and south of Victoria Street.
You indicate that your design concept will not aporeciably change
the exis:ing drainage pattern. Asphalt concrete swales will be con-
strucLed along the new roadway shoulders to drain the street run-off
int0 areas north and south of Victoria Street, similar to existing
conditic:�s. Neither the total run-off nor the drainage area 'vi111 be
increased. The existing street grades will be flattened to some
extent, resulting in reduced velocity of flow and increased time of
concentration. Additionally, a new storm drain will be added on
Victoria Street, which wi11 carry some water directly into the flood
control channel.

The law caith respect to liability for surface water drainage has
txaditianally been a curious admixture of differing legal theories
having, especially.in the appropriation area, distinctly regional
characters, all of which attempt to adjust the rights as between
adjoining landowners to take, use or deposit water from, or upon
nQighboring land. As is the case in many other areas of the laca,
the first doctrines to emerge were rather formalized (and hence
inflexible) statements of rights, which often lead to harsu results
b�cause, while they were easy to administer, they failed to take
into account individual differences in particular fact situations.
The two major doctriaes of this kind were the CObL�lON ENEMY and the
CTVIL LAS•7 rules.
The COi✓n�fOv ENEMY rule, followed in about one-third of the states,
holds that as an incident to the use of his own property, each
landowner has an unqualified right, by operations on his own land,
to fend off surface waters as ne sees fit without being required
to take into account the consequences to other landowners, who have
the rignt to protect themselves as best they can.
The CIVIL LAW rule, followed in about one-third of the states, is
diametrically opposed to the COMMON ENEMY doctrine. It recognizes
an historical state of natural drainage as betcaeen adjoining lands,
so that the lower owner must accept the surface �vater which drai�s
onto his land but, on the other hand, the upper o�aner has no right
to alter the natural system of drainage so as to.increase tfie burden.
Because many jurisdictions found it undesirable to apply either of
the above doctrines in their rigid or extreme forms, a t�ir3 rule,
generally known as the RULE OF REASO?1ABLE USE has evolved,wfiich
rule attemots to determine the rights of the parties with respect
to the disposition of surface waters by an assessment o£ all the
relevant factors. Such an approach has the virtues of flexibility
al�d of acoiding tne harsh results which cccasio:ally �ay be reac:aed
uhder extreme applicatioas of the other rules.
California at one time followed the CIVIL LA6V rule, but as a result
of the land mark case of KEYES VS ROMLEY, 64 CaI 2nd, 396 (1966),
the California Supreme Court rejected the CIVIL LATd rule in favor
of the RULE OF REASONABLE USE.
The rule in KEYES was stated by the Court thusly:
"It is therefore encus,bar.t upon every person to take
reasonable care in using his property to avoid in;nry
to adjacent prooerty through the =1orr of surface
waters. Failure to exercise reasonable care may
result in liability by an upper to a lower landowner.

From the above statement of the rule currently applied in California
with respect to the liability for surface water drainage, it would
appear that the design concept for tfie Victoria Street widening
project would meet the basic test of "reasonableness", in that the
existing drainage pattern, amount, and velocity of flow will not be
appreciably altereci, and may even be reduced to some extezt by cer-
tain design features - notably the grade reduction and the insulation
of an additional storm drain.
GoveYnmental Immunity
Of course, the above noted water law RULE OF REASONA3L£ USE applies
to both private and public projects. But in addition; public entities
have certain imr,iunities available to them in a given instance over and
! above (in this'case) an apparent].y salutary principaZ of black letter
law. The.concept of governmental immunity recognizes that public
entities, if they are to successful2y provide for tne HeaZth, Safety
and Welfare of the public, must, of necessity perforn certain services.
(i.e. police and fire,protection, public improvements, etc...) which
involve a high risk of liability. Therefore, in order to insure that
these vital services will be performed, governmental immunities are
provided.
Government Code §830.6 provides as follows:
"Neither a public entity nor a public employee is
liable under this chapter for an inju.ry caused by
the plan or design of a construction of, or an
improvement to public property where such plan or
design has been approved in advance of the con-
struction or improvement by the legislative body
of the public entity or by some other body or
employee exercising discretionary authority to
give such approval or where such plan or design
is prepared in conformity with standards previously
so approved, if the trial or appellate court deter-
mines that there is any substantial evideace upon
the basis of which (a)reasonable public employee
could have adopted the plan or design or the
standards therefore or (b) a reasonable legis-
lative body or other body or employee could have
approved the plan or design or the standards
therefore."

A reading of the cases decided under this code section since its
adoption in 1963 reveals that the majority of cases involve traffic
accidents wherein liability was claimed for negligent design of
a street proximately resulting in injury. However, it would seen
that a governmental agency, when acting under the police power with-
out negligence (e.g. constructing public improvements which inci-
dentaliy result in slight changes in water flow) wouid similarly be
entitled to the immunity afforded by Government Code �830.6.
In addition to the benefits afforded by the Keyes decision, and the
apparent applicability o£ Government Code �830.6 to the instant case,
one older CalifOrnia case, ARCHER VS CITY OF LOS AVGELES, 19 Cal 2nd
19 (1941), contains a strikingly similar fact situation to the ques-
tion currently discussed. In Archer, the plaintiff sued defendants City
which had straightened and widened a creek channe2, and constructed
storm drains following the natural drainage but did not imorove the
outlet of the creek to accommodate the increased flow to plaintiff's
land. The court heid that there was no liability to plaintiff, whose
land was flooded by overflow during a rain storm. Perhaps more
importantly, Archer has been cited as an exception to the general
rule that public entities may be liable, under Article 1, §14 of the
CaTifornia Constitution, for public improvements which entitle an
injured Landowner to recover for inverse condemnation (ALBERS VS
f COU.TTY OF LOS A:]GELES, 62 Cal 2nd 250 (1965). Since, in the instant
'• case, the likelihood of substantial damage to the State �iutual Savinqs
and Loan property seems unZikely, the Iikelihood of a successful
recovery for inverse condemnation would seem remote, and the Archer
decision should be controlling. (See also GBAY zi5 RECLA,�IATION DISTRICT,
174 Cal 622 (1917]).
CONCLUSION
Based upon the above discussion, it is.the opinion of this office
that the victoria Street coidening project, if carried out in a
manner consistent with sound engineering pYactices, caould not create
an undue risk of liability on the part oi the City.

Dear Mr. and Mrs. Stevens:
This letter is being sent to the three landowners (Stevens, Nelson & Kebow)
who seem to have a mutual problem of surface water drainage. I have in-
quired into the situation and understand the following facts:
The Kebow property was improved before the City begari imposing drainage
requirements (i.e. each development must drain its own surface water to
the nearest street or storm drain facility). Then the Stevens property
was improved in compliance with that policy. Now the Nelson property is
being improved according to said policy.
Because of the natural topography in that area the Nelson's grade improve-
ment is necessarily higher than before. He will install a block wall along
the back of his property and take care of all his own surface water. The
Stevens may also put up a block wall and take care oE their own surface
water. The problem then is - it leaves Kebow's land to take care of their
own suiface water.
Obviously, the City cannot - nor a-iIl it - adjudicate or decid= whether
"upstream" owner's such as Kebow have a prescriptive right to drain sur.-
face waters across downstream lands. There appears to be no recorded
easements so only a judicial Quiet Title action could decide those property
rights.
As far as exposure to liability by these several owners to each other we
can only point to the California Supreme Court case KEYS VS. ROMLEY, 64
Cal 2nd 396. That holds that rights, duties and liabilities for surface
water drainage will depend upon each landowner making a"reasonable use"
of his land or improvements, including taking reasonable steps to avoid
drainage. Again, absent a judicial decision on the facts here it is hard

to say what approach is "reaeonable". Believe it is up to all of you to
take whatever steps are "reasonable" to allow each other to make a reasonable
use of their own land.
In my humble opinion, the City's drainage policy of requiring each landowner
to be responsible for his own surface water is in itself "reasonable". Both
Stevens and Nelson would satisfy this now. The Kebow property would have
to establish this as "unreasonable" <or perfect an easement) and also that
reasonable steps were taken to avoid damages.
Seems to me the. most practical way to avoid the problem is as has been
suggested - by layi:g v pip= across Ste•:ens 2nd :;el�on property to the ., cr�
drain adjoining Nelson's parcel. If Stevens and Nelson both put up a block
wall without taking care of Kebow's surface water they �(?) be held to be
"unreasonable" under the circumstances and liable to Kebow in damages. Only
a Court can decide.
Trust each of you can see the merit in arriving at some mutually satisfactory
arrangement.that allows each landowner the right to i.mprove his/her land
without unresaonable burdens or costs to the other adjacent landowners. Our
City will not participate in any such negotiations and merely seeks to have
its development requirements met.

I have been asked by Mrs. Kebow to represent her in the
above-mentioned drainage problem. I have accepted as
she is my Mother-in-Law and this problem has been and
sti11 remains confusing, frustrating, and so far most
definitely expensive for her. Drainage problems are
not new to me as I was at one time a construction super-
intendent in charge of drainage for a medium-sized
construction company, although it should be said that
it was many years ago. After visiting the site during
one of our latest downpours, it became quite clear that
the problem is being compounded by the fact that with
the change in elevation created by the grading on your
property, Mrs. Kebow's property is now receiving and
retaining all of the water generated by at least three
or more of her neighbors (please see enclosed map).
As you can no deubt appreciate, tne problem created for
Mrs. Kebow is cor.mpler_ at best - if she builds a wa11
around the rear of the property and drains her water to
the street, she produces a like probLem for her neighbors,
as their lots would no longer drain. So it would seem
in the best interests of all concerned, as well as those
who in a11 probability don't even know that they are
concerned, to meet and work out an equitable solution.
