HomeMy WebLinkAbout01-22 - Proceedings for Annexation of Unincorporated Territory (Annexation No. 01-01)RESOLUTION NO. 01-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO INITIATE PROCEEDINGS FOR THE ANNEXATION OF THE UNINCORPORATED TERRITORY WITHIN THE COSTA MESA SPHERE OF INFLUENCE (ANNEXATION NO. 01-01), INCLUDING ADOPTION OF THE NEGATIVE DECLARATION. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City Council's Community Objectives Report establishes the goal of annexing unincorporated County areas into the City proactively; and WHEREAS, the City of Costa Mesa desires to annex approximately 340 acres of unincorporated territory located along its eastern boundary as shown on Exhibit A, attached hereto and by this reference incorporated herein; and WHEREAS, the City Council of the City of Costa Mesa, on its own motion, has initiated preliminary proceedings for the annexation of unincorporated territory currently located within the City of Costa Mesa's Sphere of Influence; and WHEREAS, this resolution has been prepared in accordance with, and is requested pursuant to Section 56755 of the California Government Code; and notice of intent to adopt this resolution of application has been published in a newspaper of general circulation 21 days prior to the public hearing and provided to property owners within and surrounding the subject annexation territory; and WHEREAS, the territory proposed for annexation is located within the Sphere of Influence of the City of Costa Mesa and includes the following: (1) An approximate 3 -acre unincorporated island generally located north of 201`' Street and east of Santa Ana Avenue. (Area 1) (2) An approximate 5 -acre unincorporated island generally located south of 2V Street and east of Garden Lane. (Area 2) (3) An approximate 1 -acre unincorporated island generally located at East Bay Street, east of Santa Ana Avenue. (Area 3) (4) An approximate 7 -acre unincorporated island generally located east of Santa Ana Avenue and bisected by 21' Street. (Area 4) (5) An approximate 30 -acre unincorporated area, consisting of three islands, generally located east of Santa Ana Avenue, west of Tustin Avenue, south of Santa Isabel, and north of Catalina Shore Drive. (Area 5) (6) An approximate 7 -acre unincorporated island generally located east of Santa Ana Avenue, west of Rue de Cannes and south of Back Bay Loop. (Area 6) (7) An approximate 286 -acre unincorporated parcel, generally located east of Newport Boulevard, west of the Newport Beach Sphere of Influence boundary line and the Newport Beach City boundary line, south of the Costa Mesa City boundary line, and north of Back Bay Loop and Bay View Terrace. This area includes portions of the Santa Ana Heights Specific Plan, the Santa Ana Country Club, and the Back Bay High School area (Area 7); Om WHEREAS, a Plan for Providing Services has been prepared pursuant to Section 56653 of the California Government Code and is attached as Exhibit B and incorporated herein; and WHEREAS, the City of Costa Mesa is requesting initiation of these proceedings and therefore the application to the Local Agency Formation Commission does not include a petition signed by registered voters or owners of land; and WHEREAS, in accordance with the California Environmental Quality Act and the City of Costa Mesa procedures, a Negative Declaration has been prepared and is hereby adopted; NOW, THEREFORE, the City Council of the City of Costa Mesa DOES HEREBY RESOLVE as follows: (1) The proposed annexation consists of approximately 340 acres of inhabited territory. (2) The proposed annexation is a logical extension of the present City boundaries and will eliminate the duplication of municipal services. (3) The proposed annexation of said territory will better serve the needs of said properties and owners. (4) The proposal is consistent with the City of Costa Mesa General Plan. (5) The Local Agency Formation Commission is hereby requested to undertake annexation proceedings pursuant to Government Code Section 56650. BE IT FURTHER RESOLVED that this Resolution of Application is hereby adopted and approved by the City Council of the City of Costa Mesa, and the Local Agency Formation Commission of Orange County is hereby requested to initiate proceedings for the areas as shown on Exhibit A, according to the terms and conditions stated above, and in the manner provided by Government Code Sections 56000 et seq. Deputy Cit Clerk and ex -officio Clerk of the City Coocil of the City of Costa Mesa EXHIBIT B PLAN FOR PROVIDING SERVICES TO UNINCORPORATED EASTSIDE AREAS 1) Municipal Services by the City of Costa Mesa within its jurisdiction will be provided to the affected territory subject to the attached resolution of application for annexation which includes, but is not limited to, police, fire, development services, community services, public services and related administrative services. 2) The levels and range of services shall be equal to those currently provided by the City of Costa Mesa within its jurisdiction. 3) The subject services can be feasibly extended to the affected territory at the date of annexation. 4) No improvements or upgrades to infrastructure or other conditions will be imposed by the City of Costa Mesa within the affected territory if the annexation is completed. 5) The municipal services will be financed through sales taxes and real property taxes assessed on the affected territory and through the use of the City of Costa Mesa general funds.
