HomeMy WebLinkAbout01-31 - Adopting the Mitigated Negative Declaration for E. 17th Street ImprovementsRESOLUTION NO. 0 / _ 3 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ADOPTING THE MITIGATED NEGATIVE DECLARATION FOR THE EAST 17TH STREET IMPROVEMENTS. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the Draft Mitigated Negative Declaration for East 17th Street Improvements (State Clearinghouse Number 200071126) has been prepared for alternative improvements for East 17th Street; and WHEREAS, the Draft Mitigated Negative Declaration was prepared in accordance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the City of Costa Mesa Environmental Guidelines; and WHEREAS, the Draft Mitigated Negative Declaration and accompanying Technical Appendices were circulated to the public between January 11, and February 13, 2001, for comment and review; and WHEREAS, written comments were received from the public during and after the review period; and WHEREAS, the City Council conducted a public hearing on May 21, 2001, to receive public testimony with respect to the Mitigated Negative Declaration; and WHEREAS, the Mitigated Negative Declaration reflects the independent judgment of the City of Costa Mesa, and it is comprised of the following: A. Draft Mitigated Negative Declaration for East 17th Street Improvements (SCH No. 200071126), dated January 11, 2001; B. Responses to Comments on Mitigated Negative Declaration for East 17" Street Improvements, dated March 2, 2001; and C. Mitigated Negative Declaration for East 171h Street Improvements Technical Appendices dated January 11, 2001. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa does hereby adopt Mitigated Negative Declaration for East 171' Street Improvements as complete and adequate in that it addresses all environmental effects on the project and fully complies with the requirements of CEQA, and CEQA Guidelines, and the City of Costa Mesa Guidelines. BE IT FURTHER RESOLVED that an initial study was prepared, pursuant to the California Environmental Quality Act. According to the initial study and negative declaration, which reflect the independent judgment of the City of Costa Mesa, the proposed project could not have a significant effect on the environment. Additionally the evidence in the record as a whole indicates that the project will not individually or cumulatively have an adverse effect on wildlife resources or habitat. BE IT FURTHER RESOLVED that the administrative record is located in the City of Costa Mesa Public Services Department, 77 Fair Drive, Costa Mesa, California. The custodian of the administrative record is the Director of Public Services. PASSED AND ADOPTED this 21" day of May, 2001. ..
