HomeMy WebLinkAbout01-65 - Adopting Specific Plan SP-01-01 (Santa Ana Heights Specific Plan)RESOLUTION NO. 01-65 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ADOPTING SPECIFIC PLAN SP -01-01 TO ENACT THE -PROVISIONS OF THE SANTA ANA HEIGHTS SPECIFIC PLAN WITHIN THE CITY OF COSTA MESA IN CONJUNCTION WITH PREZONING FOR TERRITORY PROPOSED FOR ANNEXATION TO THE CITY, IF AND WHEN SUCH ANNEXATION BECOMES EFFECTIVE. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City Council of the City of Costa Mesa has adopted a resolution of intent to annex a portion of the area included in the Santa Ana Heights Specific Plan adopted by the County of Orange as shown in the map attached as Exhibit A and the table attached as Exhibit B; and WHEREAS, as part of the annexation process, the Local Agency Formation Commission of Orange County may require the prezoning of property prior to approving an annexation request; and WHEREAS, in anticipation of annexation approval, and in an effort to expedite the process, the City Council desires to "prezone" the area in a manner consistent with state statutes on annexation procedure; and WHEREAS, the Santa Ana Heights Specific Plan was adopted by the Orange County Board of Supervisors per Resolution No. 85-256 on February 26, 1985, in accordance with California Government Code Sections 65450 et seq., thereby replacing zoning regulations applicable to properties within the Specific Plan boundaries with the land use regulations contained within the Specific Plan; and WHEREAS, the Santa Ana Heights Specific Plan includes Land Use Districts with regulations that are tailored to the unique history and existing mix of uses in Santa Ana Heights; and WHEREAS, the provisions of the Santa Ana Heights Specific Plan are consistent with the intent of the City of Costa Mesa General Plan for this area located in the City's Sphere of Influence; and WHEREAS, it has been determined that adoption of the relevant provisions of the Santa Ana Heights Specific Plan by the City Council of the City of Costa Mesa will not have any significant adverse affect on the _environment if and when they take effect upon annexation of the subject area, and a Negative Declaration has been adopted pursuant to the requirements of the California Environmental Quality Act; and WHEREAS, copies of the Santa Ana Heights Specific Plan are available to the public at the offices of the City of Costa Mesa Development Services Department; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa that: 1. The provisions of the Santa Ana Heights Specific Plan as adopted by the County of Orange shall continue in effect under the full jurisdiction of the City of Costa Mesa if and when such territory within the boundaries of the Specific Plan are annexed to the City of Costa Mesa. 2. The City of Costa Mesa Zoning Administrator is hereby authorized to establish administrative procedures as necessary to facilitate ongoing implementation of the Santa Ana Heights ' Specific Plan within the jurisdiction of the City of Costa Mesa pursuant to this resolution and any subsequent amendments of the Specific Plan by the City of Costa Mesa.
