A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, DENYING PLANNING
APPLICATION PA -01-25.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, an application was filed by Rhonda McCune, authorized agent
for Eugene Chan and Gladys Chock, owners of real property at 2458 Newport
Boulevard, requesting approval of a conditional use permit to allow a U -Haul truck
rental business in conjunction with an existing mini -warehouse use and outdoor
storage of a maximum of six (6) rental trucks; and
WHEREAS, the Planning Commission held a duly noticed public hearing on
August 27, 2001, and recommended denial of the request; and
WHEREAS, on September 4, 2001, Planning Action PA -01-25 was appealed
to the City Council; and
WHEREAS, a duly noticed public hearing was held by the City Council on
October 15, 2001;
NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the
record and the findings contained in Exhibit "A", the City Council of the City of
Costa Mesa hereby denies Planning Application PA -01-25 with respect to the
property described above.

EXHIBIT "A"
FINDINGS
A. The information presented does not comply with Costa Mesa Municipal Code
Section 13-29(g)(2) in that the proposed use is not compatible with
developments in the same general area. Granting the conditional use permit
will be detrimental to the health, safety and general welfare of the public or
other properties or improvements within the immediate vicinity. The use is
not consistent with the Newport Boulevard Specific Plan and the Commercial -
Residential General Plan land use designation for the property. Specifically,
the use is similar to the other motor vehicle -related uses already prohibited
within the Newport Boulevard Specific Plan. Additionally, the rental trucks,
when stored, would extend above the height of the existing walls
surrounding the site and be clearly visible to residents of adjacent
properties. The visibility of the stored vehicles does not appear to serve and
complement the residential area as stated in the Commercial -Residential land
use designation for the property nor is it compatible with the purpose of the
Newport Boulevard Specific Plan.
B. The proposed project does not comply with Costa Mesa Municipal Code
Section 13-29 (e) because:
a. The proposed use is not compatible and harmonious with uses on
surrounding properties.
b. Safety and compatibility of the design of the buildings, parking areas,
landscaping, luminaries, and other site features including functional
aspects of the site development such as automobile and pedestrian
circulation have been considered.
c. The project is not consistent with the General Plan or the Newport
Boulevard Specific Plan.
d. The cumulative effects of all past and present planning applications
have been considered for both the subject property and surrounding
properties.
C. The project has been reviewed for compliance with the California
Environmental Quality Act (CEQA), the CEQA Guidelines, and the City
environmental procedures, and has been found to be exempt from CEQA.
D. The project is exempt from Chapter XII, Article 3 Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.
