A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, APPROVING PLANNING
APPLICATION PA -01-27.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, an application was filed by David Alkema, authorized agent for
the City of Costa, with respect to real property located at 2150 Maple Street,
requesting approval of a conditional use permit for a park in the R2 -MD zone; and
WHEREAS, a duly noticed public hearing was held by the Planning
Commission on September 10, 2001; and
WHEREAS, the Planning Commission recommended approval of Planning
Application PA -01-27; and
WHEREAS, a duly noticed public hearing was held by the City Council on
October 15, 2001;
NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the
record and the findings contained in Exhibit "A", and subject to the conditions of
approval contained in Exhibit "B", the City Council of the City of Costa Mesa
hereby approves Planning Application PA -01-27 with respect to the property
described above.
BE IT FURTHER RESOLVED that the Costa Mesa City Council does
hereby find and determine that adoption of this resolution is expressly predicated
upon the activity as described in the staff report for Planning Application
PA -01-27, and upon applicant's compliance with each and all of the conditions
contained in Exhibit "B". Any approval granted by this resolution shall be subject
to review, modification, or revocation if there is a material change that occurs in
the operation, or if the applicant fails to comply with the conditions of approval.

EXHIBIT "A"
FINDINGS
APPL. PA -01-27
A, The information presented substantially complies with Costa Mesa Municipal
Code section 13-29(g)(2) in that the proposed park is substantially compatible
with developments in the same general area. Granting the conditional use
permit will , not be detrimental to the health, safety and general welfare of the
public or other properties or improvements within the immediate vicinity.
Specifically, the park has been designed and will be conditioned to minimize
impacts on adjoining residents. Additionally, provision of park area, especially
when visible to a public street, is a goal of the City's General Plan. Granting the
conditional use permit will not allow a use, density or intensity that is not in
accordance with the general plan designation for the property.
B. The project has been reviewed for compliance with the California Environmental
Quality Act (CEQA), the CEQA . Guidelines, and the City environmental
procedures, and has been found to be exempt from CEQA.
C. The project is exempt from Chapter XII, Article 3, Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.
EXHIBIT "B"
CONDITIONS OF APPROVAL

Ping. 1.
Lighting shall be designed so it does not spillover onto
surrounding residential properties. This condition shall be
completed to the satisfaction of the Planning Division and may
require the preparation of a photometric survey.
Trans. 2.
Relocate locking gate at new drive approach on Maple Street a
minimum 20 feet behind the Maple Street property line.
3.
Remove the handicap ramp located in the public sidewalk in front
of the park plaza entry.
Eng. 4.
Maintain the public right-of-way in a "wet -down" condition to
prevent excessive dust and promptly remove any spillage from the
public right-of-way by sweeping or sprinkling.
Police 5.
A list of security recommendations has been provided by the Police
Department for the applicant's consideration.
6.
The 8 -foot north property line wall shall continue to the front
property line. The southern wall along Victoria Street shall be
modified with consideration to cost, to comply with code using
wrought iron on the top portion of the wall, to provide visibility into
the park.

CODE REQUIREMENTS
The following list of federal, state and local laws applicable to the project has been
compiled by staff for the applicant's reference. Any reference to "City" pertains to
the City of Costa Mesa.
Ping. 1.
All contractors and subcontractors must have valid business
licenses to do business in the City of Costa Mesa. Final
inspections will not be granted until all such licenses have been
obtained.
Eng. 2.
At the time of development submit for approval an off-site plan to
the Engineering Division and grading plan to the Building Division
that shows sewer, water, existing parkway improvements and the
limits of work on the site, and hydrology calculations, both
prepared by a civil engineer or architect. Construction access
approval must be obtained prior to building or engineering permits
being issued by the City of Costa Mesa. Pay offsite plan check fee
to the Engineering Division. An approved offsite plan and fee shall
be required prior to engineering/utility permits being issued by the
City.
3.
A construction permit for street sweeping will be required by the
Engineering Division prior to the start of any on- or off-site work.
4.
Obtain a permit from the Engineering Division, at the time of
development and then construct P.C.C. residential sidewalk per
City of Costa Mesa standards as shown on the offsite plan,
including four (4) feet clear around obstructions in the sidewalk.
5.
Obtain a permit from the Engineering Division at the time ,of
development and then construct P.C.C. driveway approach per
City of Costa Mesa standards as shown on the offsite plan.
Location and dimensions are subject to the approval of the
Transportation Services Manager. A.D.A. compliance is required
for all driveway approaches.
6.
Obtain a permit from the Engineering Division, at the time of
development and then remove any existing driveways and/or curb
depressions that will not be used and replace with full height curb
and sidewalk at applicant's expense.
7.
Applicant is advised that Maple Street is tentatively scheduled for
street maintenance in July 2002. No cutting of street pavement
will be approved by the City Engineer for a period of 5 years after
acceptance of street improvements by the City except with
special resurfacing conditions.
Bldg. 8.
Comply with the requirements of the Uniform Building Code as to
design and construction and CCR Title 24 pertaining to "Disabled

Access Regulations".
9. Prior to or concurrent with submittal of plans for building plan
check, applicant shall submit a Water Quality Management Plan
(WQMP) that identifies the application and incorporation of those
routine structural and non-structural Best Management Practices
(BMPs) outlined in the Countywide National Pollution Discharge
Elimination System (NPDES) Drainage Area Management Plan
(VAMP), Appendix G. The WQMP shall detail implementation of
BMPs not dependent on specific.land uses, for review and approval
by the Development Services Department.
