02-05 - City Employment for Veterans of the Armed Forces as Required by Govt Code Sec 50088
RESOLUTION NO. Da-� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ENDORSING THE CITY'S MERIT SYSTEM PRINCIPALS AND PROVIDING REASONS FOR NOT ADOPTING A PROGRAM OF PREFERENCES IN CITY EMPLOYMENT FOR VETERANS OF THE ARMED FORCES AS REQUIRED BY GOVERNMENT CODE SECTION 50088. WHEREAS, in 1999 the California Legislature enacted Government Code Section 50088 that requires all local governments to take action by.January 2002 - to either (1) enact a system of employment preferences for veterans of the armed forces or (2) adopt a resolution explaining why the local government has declined to adopt such a system of preferences; and, WHEREAS, the City of , Costa Mesa has consistently and successfully operated under its current merit system principals of employment; and, WHEREAS, preferences are perceived to be the antithesis of merit competition because those benefiting from preferences are given an advantage over others based on their status, not on their abilities; and, WHEREAS, preferences were banned by the California Constitution under Proposition 209 for nearly every segment of the population except for veterans; and, WHEREAS, it is the City's experience that veterans have been earning their way into employment and advancement in the City of, Costa Mesa based on their own skills and talent without the additional advantage of veterans' preferences; and, WHEREAS, the City of Costa Mesa is proud of the large number of veterans in its workforce and provides them with every opportunity to demonstrate and use the capabilities they may have acquired during their military service for the benefit of the City; and, WHEREAS, the City of Costa Mesa encourages military service of its employees by providing full benefits during their annual military training and by providing full benefits and pay supplements to employees called to active duty to serve their country during times of military crisis; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COSTA MESA AS FOLLOWS: 1. The City endorses its current merit system principals of employment and will not enact a special program of preferences in'City employment for veterans for the reasons stated in this Resolution. 2. The retroactive effective date of this Resolution shall be January 1, 2002. PASSED AND ADOPTED this 22nd day of Janua , 2002.
