HomeMy WebLinkAbout02-09 - Adopting General Plan Amendment GP-01-04, Property at 1904 Federal AveRESOLUTION NO. 0 a- � A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA ADOPTING GENERAL PLAN AMENDMENT GP -01-04 FOR PROPERTY.AT 1990 AND 1904 FEDERAL AVENUE. THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES AS FOLLOWS: WHEREAS, an application was filed by the City of Costa Mesa with respect to property located at 1900 and 1904 Federal Avenue, requesting a General Plan amendment changing the land use designation from General Commercial to Low Density Residential; and WHEREAS, the City Council of the City of Costa Mesa certified Final Program Environmental Impact Report (EIR) No. 1049 and General Plan Amendment GP -01-01, City of Costa Mesa 2000 General Plan plus Home Ranch Alternative A by adoption of Resolution Nos. 01-86 and 01-87, respectively, on December 17, 2001; and WHEREAS, the General Plan is a long-range comprehensive document which serves as a guide for the orderly development of Costa Mesa; and WHEREAS, by its very nature, the General Plan needs to be updated and refined to account for current and future community, needs; and WHEREAS, the Planning Commission of the City of Costa Mesa recommended adoption of the Negative Declaration and General Plan Amendment GP -01-04; and WHEREAS, duly noticed public hearings were held by the Planning Commission on October 22, 2001, and by the City Council on December 17, 2001; and WHEREAS, the project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and an Initial Study/Negative Declaration was prepared and available for public review from September 28, 2001 to October 18, 2001; and WHEREAS, this Council deems it to be the best interest of the City that said Amendment to the General Plan be adopted NOW THEREFORE BE IT RESOLVED that the Costa Mesa City Council does hereby adopt the Negative Declaration and General Plan Amendment GP -01-04, designating the property located at 1900 and 1904 Federal Avenue as Low Density Residential on the Land Use Map, and amends the text of the General Plan as set forth in Exhibit A attached to this resolution. BE IT FURTHER RESOLVED that an initial study was prepared, pursuant to the California Environmental Quality Act. According to the initial study and negative declaration, which reflect the independent judgment of the City of Costa Mesa, the proposed project could not have a significant effect on the environment. Additionally, the evidence in the record as a whole indicates that the project will not individually or cumulatively have an adverse effect on wildlife resources or habitat.
