Dear Mrs . Hughes and Messrs. Hughes :
As you are aware, the City of Costa Mesa has entered into an
agreement with the Department of Housing and Urban Development
to assist the City in providing for commercial rehabilitation
and other economic development activities to benefit low and
moderate income neighborhoods. The City has adopted Commercial
Rehabilitation Guidelines which provide for the Commercial
Rehabilitation Program, which includes rehabilitation and/or
renovation of numerous parcels of real property located in the
downtown area of the City of Costa Mesa, specifically the commer-
cial buildings on easterly Newport Boulevard between 18th Street
and Broadway. The Hughes family owns , in fee simple, real prop-
erty located in the City of Costa Mesa, County of Orange, State
of California , which is within the rehabilitation project site
and located at 1806 Newport Boulevard, 1808 Newport Boulevard
and the southwesterly nine feet, more or less, of 1810 Newport
Boulevard which addresses are known as Assessor Parcel Number
424-451-03.
You have executed an Owner Cooperation Agreement (Doc. 85-300364)
which was recorded on August 13, 1985 , to effectuate the Commercial
Rehabilitation Program. Therein , you agreed to the construction
of certain facade improvements to the building on your property
to be funded by federal funds as part of the Commercial Rehabili-
tation Program.
The construction of the facade improvements for the Commercial
Rehabilitation Program have commenced and you are now aware that
certain structural conditions exist in the building on your
property which conditions may be hazardous and may require struc-
tural modifications and improvements. Due to the age of the

buildings on the property, you realize the buildings do not con-
form to current Uniform Building Code requirements for new
construction as to earthquake resistance. However, at this date,
no state or Costa Mesa laws or regulations mandate retrofitting
or modifying existing privately owned buildings to be earthquake
resistant. You also realize structural improvements are required
in the event the adjacent buildings at 1804 Newport Boulevard
are altered or removed, or any actions occur which affect the
adjacent support of your building or modifications are required
by law.
You are aware and are familiar with the statement prepared by
Robert Lawson, Structural Engineers , 312 Ocean Avenue , Laguna
Beach, California 92651 , regarding the structural integrity of
your building at 1806-1808 Newport Boulevard (copy attached) .
This letter is to advise you the City of Costa Mesa does not have
and does not accept any liability or responsibility in any respect
with regard to the condition, structural or otherwise, of your
property at 1806-1808 Newport Boulevard. The City reminds you
and confirms the continuing obligations contained in the Owner
Cooperation Agreement, particularly with regard to conformance
of your property with all laws and regulations. As established,
responsible property owners, you understand and are advised of
the need to maintain the structural integrity of your buildings .
The Lawson letter states numerous observations about the struc-
tural soundness of your property. The recommendations in the
Lawson letter should be monitored and followed by you. A copy
of this letter and attachment will be on file in the Building
Department. You should advise any and all successors to your
interests of the structural conditions of this property.

Dear Pat,
In answer to your question regarding the structural integrity of
the hollow clay tile walled building at 1806-1808 Newport Blvd. ,
I wish to make the following observations'
1) As the building existed prior to the reinforcement which
we have proposed, a major seismic event on the Newport-
Inglewood fault at its ' closest proximity to the site,
would probably result in a collapse of the north wall ,
failure of the supported roof, and collapse of the concrete
lintel at the front (Newport Blvd. ) wall .
2) The modifications which we have detailed, when subjected
to the same seismic event, will prevent collapse of the
north wall and roof. The front wall will remain intact
as well as act to support the lintel . There will probably
be cosmetic damage to the building, but total failure
will be averted..
3) It should be noted that, as it exists, the south wall is
supported from collapse by the adjacent masonry wall of
1804 Newport Blvd. If at any time that (1804) wall is
removed or weakened, the building at 1806 would immediately
be in jeopardy of failure during a major seismic event.
This information should be passed on to all present and
future owners and occupants of 1806 as well as the present
and future owners of 1804. In addition this information
should be flagged for both addresses in the City of Costa
Mesa files, so that should the worst case occur it will
be dealt with promptly and decisively.
