A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, REQUESTING BOARD OF
SUPERVISORS APPROVAL OF AN AMENDMENT TO
THE JOHN WAYNE AIRPORT SETTLEMENT AGREEMENT
COiVSISTENT WITH SCENARIO 1 IN ENVIRONMENTAL
IMPACT REPORT (EIR) 582.
WHEREAS, the John Wayne Airport (JWA) Settlement Agreement
(Settlement Agreement) establishes limits on the number of passengers and noise
regulated departures consistent with the limited physical facilities at JWA (number
of gates and size of the terminal); and
WHEREAS, the County of Orange - through the efforts of the Board of
Supervisors (Board), Chief Executive Officer (CEO), Airport Director (Director) and
Special Counsel (Counsel) - has strictly complied with the letter and spirit of the
Settlement Agreement; and
WHEREAS, a substantial number of residents in the cities of Anaheim, Costa
Mesa, Newport Beach, Santa Ana, Orange and Tustin (Corridor Cities) are
adversely impacted by noise, air pollution, and/or traffic generated by commercial
aircraft operations at JWA; and
WHEREAS, the County of Orange has prepared EIR 582 which evaluates the
potential impacts of three "Scenarios" (Scenarios 1, 2 and 3) - each of which
assumes some increase in the term of the Settlement Agreement, the number of
noise regulated departures and the number of passengers; and
WHEREAS, the .City Council of the City of Costa Mesa has consistently
opposed any relaxation of the limitations established in the Settlement Agreement
in the interest of protecting residents of 'the community currently impacted by
JWA; and
WHEREAS, the Settlement Agreement expires in December, 2005 and
absent extension of the protections included in the Agreement or adoption of one
of the three Scenarios identified in EIR 582, Costa Mesa residents will be exposed
to unrestricted adverse impacts of JWA; and
WHEREAS, the City Council of the City of Costa Mesa continues to support
extension of the current restrictions in the Settlement Agreement as the best
means of protecting residents; and
WHEREAS, the loss of all protections afforded by the existing Settlement
Agreement would create an unwarranted adverse impact on thousands of Costa
Mesa residents, resulting in the loss of community, privacy, and quality of
life; and
WHEREAS, support for Scenario .1 in EIR 582 would provide the greatest
amount of protection for Costa Mesa residents in the event the Settlement
Agreement is not extended as currently constituted; and
WHEREAS, the elected officials of the Corridor Cities have unanimously
supported an amendment of the Settlement Agreement consistent with Scenario 1
to protect the quality of life and property values of their respective constituents
and comply with Federal Law; and
WHEREAS, the elected representatives of the Corridor Cities request the
Board of Supervisors to approve a Settlement Agreement amendment consistent
with Scenario 1.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA
requests that the Board of Supervisors certify EIR 582 and approve a Settlement
Agreement amendment consistent with Scenario 1.
