HomeMy WebLinkAbout02-26 - Approving Minor Design Review ZA-01-69RESOLUTION NO. 4o7 --a.6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING MINOR DESIGN REVIEW ZA-01-69. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by Jeffrey Hutter with respect to real property located at 282 Esther Street, requesting approval of a minor design review to construct a two-story, single-family residence in the R1 zone; and WHEREAS, Minor Design Review ZA-01-69 was approved by the Zoning Administrator on March 7, 2002; and WHEREAS, this item was appealed on March 8, 2002; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on March 25, 2002, and the commission approved Minor Design Review ZA-01-69; and WHEREAS, an application was filed on March 28, 2002, for City Council review of Minor Design Review ZA-01-69; and 2002; WHEREAS, the City Council held a duly noticed public hearing on April 15, NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and the findings contained in Exhibit "A", and subject to conditions contained in Exhibit "B", the City Council hereby APPROVES Minor Design Review ZA-01-69 with respect to the property described above. BE IT FURTHER RESOLVED that the Costa Mesa City Council does hereby find and determine that adoption of this resolution is expressly predicated upon the activity as described in the staff report for Minor Design Review ZA-01-69, and upon applicant's compliance with each and all conditions contained in Exhibit "B". Should any material change occur in . the operation, or should the applicant fail to comply with the conditions of approval, then adoption of this resolution shall be subject to review, modification, or 'revocation. The proposed development is substantially compatible and harmonious with existing and/or anticipated development on surrounding properties. This includes site planning, landscaping, appearance, scale of structures, location of windows, and any other applicable features relative to a compatible and attractive development. Specifically, privacy impacts on side neighbors should be minimal because the closest windows to the property line (5 feet away) are for a bathroom on the west side of the house and other windows are placed a minimum of 7 to 117 feet from side property lines. Houses on -.both sides of the._ property are single story, so there will be no second -floor window alignment concerns. With the placement of the house towards the front of the lot, impacts on rear yard privacy of the two adjoining neighbors should be minimized. Impacts on toe rear neighbor will be nonexistent because the new construction will be separated from the rear neighbor by the existing two-story garage/accessory apartment structure and alley at the back of this site. The proposed project satisfies applicable development 'standards and review criteria for a two-story residence and is compatible with the Eastside's eclectic mix of residences. Approval will not'increase the number of units currently existing on the property. B. The proposed project complies with Costa Mesa Municipal Code Section 13-29 (e) because: a. The proposed development and use is compatible and harmonious with uses both on-site as well as those on surrounding properties. b. Safety and compatibility of the design of the buildings, parking areas, landscaping, luminaries, and other site features including functional aspects of the site development such as automobile and pedestrian circulation have been considered. C. The proposed project complies with applicable performance standards prescribed in the Zoning Code; d. The project is consistent with the General Plan. e. The planning application is for a project -specific case and does not establish a precedent for future development. f. The cumulative effects of all past and present planning applications have been considered for both the subject property and surrounding properties. B. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. C. The project is exempt from Chapter XII, Article 3, Transportation System Management, of Title 13 of the Costa Mesa Municipal Code. EXHIBIT "B" CONDITIONS OF APPROVAL APPL. ZA-01-69 Ping. 1. The subject property's ultimate finished grade level may not be filled/raised in excess of 30" above the finished grade of any abutting property. If additional fill dirt is needed to provide acceptable onsite stormwater flow to a public street, an alternative means of accommodating that drainage shall be approved by the City's Building Official prior to issuance of any grading or building permits. Such alternatives may include subsurface tie-in to public stormwater facilities, subsurface drainage collection systems and/or sumps with' mechanical pump discharge in -lieu of gravity flow. If mechanical pump method is determined appropriate, said mechanical pump(s) shall continuously be maintained in working order. In any case, development of subject ` property shall preserve or improve the existing pattern of drainage on abutting properties. 2. All new construction shall be architecturally compatible with regard to building materials, style, colors, etc. with the existing structure. Plans submitted -for plan check shall indicate how this will be accomplished. 3. The applicant shall contact AT&T. Cable Television of Costa Mesa at 200 Paularino, Costa Mesa, (549-3535) prior to issuance of building permits to arrange for pro -wiring for future cable communication service. 4. The applicant shall contact the Planning Division to arrange for a "special requirements" inspection of the site prior to the release of occupancy/ utilities. This inspection is to confirm that the conditions of approval and code requirements have been satisfied. 5. Four (4) sets of detailed landscape and irrigation plans shall be required as part of the project plan check review and approval process. Three (3) sets shall be provided to the representative water agency and one (1) set shall be submitted to the Planning Division for review. Plans shall be approved by the water agency with two (2) approved sets forwarded by the applicant to the Planning Division for final approval prior to issuance of building permits. 6. Two (2) sets of landscape and irrigation plans, approved by both the water agency and the Planning Division, shall be attached to two of the final building plan sets. 7. Landscape and irrigation plans shall meet the requirements set forth in Costa Mesa Municipal Code Sections 13-101 through 13-108 as well as irrigation requirements set forth by the water agency. Consult with the representative water agency Mesa Consolidated Water District, (949) 631-1291 for requirements. 8. Landscaping and irrigation shall be installed in accordance with the APPL ZA-01-69 approved plans prior to final inspection or occupancy clearance. 9. Existing mature trees shall be retained wherever possible, and shall not be removed without prior written. approval of the Planning Division. Should it be necessary to remove existing trees, the applicant shall submit a written request and justification to the Planning Division. A report from a California licensed arborist may be required as part of the justification. Replacement trees shall be 'of a size consistent with trees to be removed and may be required on a 1:1 basis. This condition shall be completed under the direction of the Planning Division. Trans. 10. Specify on site plan if existing drive approach will be utilized for new garage. Eng. 11. Maintain the public right of way in a wet -down condition to prevent excessive dpst and remove any spillage from the publiq right of way by sweeping or sprinkling.
