A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, DENYING MINOR DESIGN
REVIEW ZA-01-63.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, an application was filed by John Clark, with respect to the real
property located at 1167 Aviemore Terrace, requesting approval of minor design review
to allow construction of a second floor addition to a single-family residence in the R1
.zone; and
WHEREAS, on February 28, 2002, the Zoning Administrator approved Minor
Design Review ZA-01-63; and
WHEREAS, an application was filed on March 5, 2002, for City Council review of
Minor Design Review ZA-01-63; and
WHEREAS, on April 1, 2002, the City Council referred the item to Planning
Commission for their review; and
WHEREAS, Planning Commission upheld the Zoning Administrator's approval at
their duly noticed public hearing of May 28, 2002; and
WHEREAS, an application was filed on June 3, 2002, and an appeal was filed
on June 4, 2002, for City Council review of Minor Design Review ZA-01-63; and
WHEREAS, the City Council continued the item to August 5, 2002, at their
meeting of July 1, 2002; and
2002.
WHEREAS, the City Council held a duly noticed public hearing on August 5,
NOW, THEREFORE, BE IT RESOLVED that, based on the evidence in the
record and the findings contained in Exhibit "A", the City Council of Costa Mesa hereby
denies Minor Design Review ZA-01-63 with respect to the property described above.
PASSED AND ADOPTED this 5th day of August, 2002.

EXHIBIT "A"
FINDINGS

A. The neighborhood which includes the property located at 1167 Aviemore, Terrace
is unique in the City of Costa Mesa. It is a terraced community which was
designed and constructed to take advantage of its location along . the coastal
bluffs in the southwesternportion of the City. The homes originally constructed
included only single story homes along the terraced portions of the project, which
includes Aviemore Terrace as well as Gleneagles Terrace, so as to afford the
benefits of the location of the project to as many homes as possible. For the
most part these homes remain as single story homes. Since the original
development of the project, only one second story home has been constructed
on Aviemore Terrace. This home was designed with a low profile and is on a lot
which is terraced below the applicants' property and does not impact adjacent
properties or the neighborhood. There are no two-story homes on the southern
side of Gleneagles Terrace which overlooks Aviemore Terrace with the exception
of a small loft which was added to the propertyat the upper end of Gleneagles
Terrace. Other two story homes within the neighborhood are located on portions
of the project which are not terraced.
B. The proposed project is located at the upper end of Aviemore Terrace. The
property at this location is the highest point on Aviemore Terrace. The height of
the proposed project is approximately 8 feet higher than the existing home at
1167 Aviemore Terrace and due to the height of the grade at that point will
appear significantly higher than the balance of the homes on Aviemore Terrace.
C. Based on the foregoing facts and the evidence presented to the City Council
both in writing and orally at the public hearing on this matter, the City Council
finds and determines that the proposed project does not meet the requirements
set forth in Section 13-29(g)(14) in that the proposed project is not compatible or
harmonious with the existing development. The height and square footage of
the proposed project creates a mass and a scale that is inconsistent with the
existing homes on Aviemore Terrace. In addition, while the City does not
regulate views in general, the character of this neighborhood is based on the
terraced design and the low profile of the down slope homes which is intended to
capture light and air unique to this coastal bluff environment. The proposed
project is incompatible with this characteristic of the neighborhood.
