A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA, DENYING
REZONE PETITION R-02-02 AND PLANNING
APPLICATION PA -02-10
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, an application was filed by Farhad E. Khosravi, owner of real property
located at 258 Santa Isabel Avenue, requesting a rezone from R1 (Single Family
Residential) to PDR=LD (Planned Development Residential -Low Density) and a variance
to deviate from minimum development lot size required for PDR -LD zoning (1 acre
required; .64 acre proposed) with a master plan and design review proposal to construct a
detached, 5 unit, two story, small lot residential project with variances to deviate from the
minimum individual lot size requirements (5,000 square feet required; 3,410 square feet
proposed); and
WHEREAS, a duly noticed public hearing was held by the Planning Commission
on July 22, 2002; and
WHEREAS, the Planning Commission recommended denial of Rezone Petition R-
02-02 and Planning Application PA -02-10; and
WHEREAS, a duly noticed public hearing was held by the City Council on August
19, 2002.
NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record
and the -findings contained -in Exhibit "A", the City Council hereby denies Rezone Petition
R-02-02 and Planning Application PA -02-10 with respect to the property described above.

EXHIBIT "A"
FINDINGS
A. The information presented does not comply with Costa- Mesa Municipal Code
Section 13-29(g)(1) because there are no special circumstances applicable to the
property such as an unusual lot size, lot shape, or topography that would justify
approval of the varianbe from the 1 acre minimum lot size requirement for the
PDR -LD zone. Specifically, the site is a flat rectangular lot substantially larger
than a standard R1 lot, which -the property is currently zoned.
B. The information presented does not comply with Costa Mesa Municipal Code
Section 13-29(g)(1) because there are no special circumstances applicable to the
property such as an unusual lot size, lot shape, or topography that would justify
approval of the variance from the 5,000 square foot minimum individual lot size
and 5,500 square foot average individual lot size for the proposed development.
Specifically, the site is deficient in the minimum 1 acre lot size required for the
PDR -LD zone; as a result, neither the minimum or average individual lot sizes
required by code can be accommodated in the proposed development.
C. .: The information presented does not comply with Costa Mesa Municipal Code
Section 13-29(8)(5) because the master plan does not meet the broader goals of
the General Plan and the Zoning Code ,by exhibiting excellence in design, site
planning, integration of uses and structures,, and protection of the integrity of
neighboring development. Specifically, the proposed development does not
meet the minimum and average lot sizes required by code for the PDR -LD zone.
D. The information presented does not comply with Costa Mesa Municipal Code
Section 13-29(8)(14) because the proposed development is -not compatible or
harmonious with existing and/or anticipated development on surrounding
properties. Specifically, the proposed development does not meet the -minimum
and average lot sizes required by code for the PDR -LD zone. Additionally, the
second story floor area exceeds -he maximum 80% of the first story floor area
required per the City's Residential Design Guidelines.
E. The project has been reviewed for compliance with the California Environmental
Quality Act (CEQA), the CEQA Guidelines, and the City environmental
procedures, and has been found to be exempt from CEQA.
F. The project is exempt from Chapter XII, Article 3 Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.
