The home-based business will allow the property owner to maintain her chiropractor license while being a full time mother. Staff supports the proposed use because the business does not involve more than one client/customer at a time and because this type of business is limited in its ability to serve more than one client/customer at a time. The information presented complies with Costa Mesa Municipal Code Section 13-29(g)(2) in that allowing a home-based chiropractic business is compatible with developments in the same general area. Granting the minor conditional use permit will not be detrimental to the health, safety, and general welfare of the public or other properties or improvements within the immediate vicinity. Specifically, the proposed business will be restricted to one client/customer at a time and a maximum four clients/customers per day. Granting the minor conditional use permit will not allow a use, density, or intensity that is not in accordance with the general plan designation for the property. B. The proposed use complies with Costa Mesa Municipal Code Section 13-29(e) because: 1. The proposed use is compatible and harmonious with uses both on-site as well as those on surrounding properties. 2. The use is consistent with the General Plan designation for the property. 3. The zoning application is for a project -specific case and does not establish a precedent for future development. C. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from Class 1 of CEQA. D. The project is exempt from Chapter XII, Article 3, Transportation System Management, of Title 13 of the Costa Mesa Municipal Code. CONDITIONS OF APPROVAL Ping. 1. The use shall be limited to the type of operation described in the staff report, i.e., the home-based chiropractic business restricted to a maximum of four clients/customers per day, and not more than one client/customer at a time. The applicant shall institute whatever operational measure necessary to comply with this requirement. 6. If parking shortages or other parking -related problems arise, the applicant shall institute whatever operational measures necessary to minimize or eliminate the problem, including, but not limited to, reducing the number of clients/customers. 7. The minor conditional use permit herein approved shall be valid until revoked, but shall expire upon discontinuance of the activity authorized hereby for a period of 180 days or more. The minor conditional use permit may be referred to the Planning Commission for modification or revocation at any time if the conditions of approval have not been complied with, if the use is being operated in violation of applicable laws or ordinances, or if, in the opinion of the Zoning Administrator or his designee, any of the findings upon which the approval was based are no longer applicable. 8. The home occupation shall not involve the use of commercial vehicles for delivery of materials to or from the premises, other than a vehicle of no more than one ton capacity, owned by the operator of the home occupation, which shall be stored in an entirely enclosed garage. The storage of equipment such as trailers, tractors, trucks in excess of one ton, wheeled construction equipment, etc. is not permitted. 11. The home occupation shall not generate pedestrian or vehicular traffic beyond that normal to the neighborhood where it is located. 12. The home occupation shall not result in or generate parking or storing of commercial vehicles on public streets.
