A RESOLUTION OF THE CITY COUNCIL OF THE `
CITY OF COSTA MESA, CALIFORNIA,
REQUESTING THE ORANGE COUNTY
TRANSPORTATION AUTHORITY TO ALLOCATE
COMBINED TRANSPORTATION PROGRAM FUNDS
FOR ENVIRONMENTAL AND DESIGN SERVICES
FOR IMPROVEMENTS TO NEWPORT BOULEVARD
BETWEEN 17TH STREET AND 19TH STREET.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, the Orange County Transportation Authority approved a Combined
Transportation Funding Program (CTFP) for fiscal year 2002-2003;
WHEREAS, the CTFP includes Ninety -Five. Thousand Dollars ($95,000.00) in
fiscal year 2002-2003 for a growth management area project on Newport Boulevard
between 17th Street and 19th Street; and
WHEREAS, the City of Costa Mesa has adopted a General Plan Circulation
Element that does not preclude implementation of the Master Plan of Arterial Highways
within its jurisdiction.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa
Mesa, California, hereby requests the Orange County Transportation Authority allocate
Eighty -Five Thousand Five Hundred Dollars ($85,500.00) of CTFP funds from the growth
management area project for the construction of said project to the City. This request is
in conformance with the CTFP allocation process and does not exceed ninety percent
(90%) of the programmed amount or ninety percent (90%) of the construction contract.
BE IT FURTHER RESOLVED, that the City of Costa Mesa -agrees to fund its
share of the improvement costs of the above indicated fiscal year and any additional
costs over the identified programmed amount.
BE IT FURTHER RESOLVED, that the City of Costa Mesa has awarded the
contract for the project on January 21, 2003, for Seven Hundred Eighty -Nine Thousand
Four Hundred Thirty -Four Dollars ($789,434.00).
BE IT FURTHER RESOLVED, that the City of Costa Mesa will 1) design the
project improvements and 2) complete the required preparatory'work in accordance with
the standards required by the City and other affected jurisdictions involved with said
project.
BE IT FURTHER RESOLVED, that the remaining ten percent (10%) in CTFP
funds will be transferred to the City of Costa Mesa when construction is completed and a
Final Report on the project is accepted by the Orange County Transportation Authority.
The City of Costa Mesa agrees to submit the Final Report to the Orange County
Transportation Authority within one hundred twenty (120) days after the City's acceptance
of the improvements.
