HomeMy WebLinkAbout03-15 - Approving Minor CUP ZA-02-58RESOLUTION NO. c 3-15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING MINOR CONDITIONAL USE PERMIT ZA-02-58. THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES AS FOLLOWS: WHEREAS, an application was filed by John Grey, representing Wells Fargo Bank, N.A., Trustee of the Dion Trust, with respect to the real property located at 837 West 17th Street, requesting approval of a minor conditional use permit for outdoor storage of vehicles in the MG zone; and WHEREAS, on January 16, 2003, the Zoning Administrator approved Minor Conditional Use, Permit ZA-02-58; and WHEREAS, an appeal application was filed on January 23, 2003, by Council Member Allan Mansoor; and WHEREAS, Planning Commission held a duly noticed public hearing on February,10, 2003; and WHEREAS, the Planning Commission approved the minor conditional use permit - on February 10, 2003; and WHEREAS, the item was appealed to the City Council on February 12, 2003, . and a duly noticed public hearing was held by the City Council on March 3, 2003; and WHEREAS, the item was continued, and a public hearing was held by the City Council on March 17, 2003. NOW, THEREFORE, BE IT RESOLVED that, based on the evidence in the record and the findings contained in Exhibit "A", the City Council of the City of Costa Mesa hereby APPROVES Minor Conditional Use Permit ZA-02-58 with respect to the property described above. BE IT FURTHER RESOLVED that the Costa Mesa Planning Commission does hereby find and determine that adoption of this resolution is expressly predicated upon the activity as described in the Staff Report for Minor Conditional Use Permit ZA-02-58 and upon applicant's compliance with each and all of the conditions contained in Exhibit "B". Any approval granted by this resolution shall be subject to review, modification or revocation if there is a material change that occurs in the operation, or if the applicant fails to comply with any of the conditions of approval. The information presented substantially complies with Section 13-29(g)(2) of the Costa Mesa Municipal Code in that: a. The proposal to, allow outdoor auto storage at this location, as conditioned, is substantially compatible with the generally -industrial developments in the same general area. b. Granting the minor conditional use permit, as conditioned, will not be detrimental to the health, safety and general welfare of the public or other properties or improvements within the immediate vicinity. Specifically, the use will consist of parking vehicles in good condition until they are moved for sale, and the storage/parking areas will be screened from view from the street as well as adjoining properties by existing buildings and fences. c. Granting the minor conditional use permit, as conditioned, will not allow a use, density or intensity which is not in accordance with the general plan designation for the property. 2. The proposed project complies with Costa Mesa Municipal Code Section 13-29 (e) because: a. The proposed development and use is compatible and harmonious with uses both on-site as well as those on surrounding properties. b. Safety and compatibility of the design of the parking area, landscaping, luminaries, and other site features including functional aspects of the site development such as automobile and pedestrian circulation have been considered. c. The project is consistent with the General Plan. d. The planning application is for a project -specific case and does not establish a precedent for future development. 3. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. 4. The project is exempt from Chapter XII, Article 3 Transportation System Management, of Title 13 of the Costa Mesa Municipal Code. 5. The installation of landscaping in the front setback will mitigate the negative impact of allowing outdoor storage of over 20 vehicles on the site. EXHIBIT "B" CONDITIONS OF APPROVAL Ping 1. 13 customer/employee parking stalls shall be striped as shown on the site plan. A scaled site/parking plan shall be submitted to the Planning Division for approval prior to striping of the lot. This condition shall be completed under the direction of the Planning Division. 2. The outdoor auto storage area between Office C and Garage #1 shall not project further west than the building to ensure adequate back -out distance for the parking stalls. 3. Street addresses shall be displayed on the freestanding sign or, if there is no freestanding sign, on the block wall adjacent to the entry drive, in a manner visible to the public street. Numerals shall be a minimum 12" in height with not less than 3/4" stroke and shall contrast sharply with the background. 4. The site shall be used for vehicle storage purposes only. No other work including, but not limited to, repair and dismantling shall be conducted on- site. 5. The site shall not be used for the storage of wrecked or dismantled vehicles. 6. The___.minorconditional use permit herein approved shall be valid until revoked, but shall expire upon discontinuance of the activity authorized hereby for a period of 180 days or more. The conditional use permit may be referred to the Planning Commission for modification or revocation at any time if the conditions of approval have not been complied with, if the use is being operated in violation of applicable laws or ordinances, or if, in the opinion of .the development services director or his designee, any of the findings upon which the approval was based are no longer applicable. 7. A list of security recommendations has been provided by the Police Department for the applicant's consideration.
