PROJECT DESCRIPTION
■ The property is zoned R1 (Single-Family Residential), has a General Plan
designation of Low Density Residential, and contains a single-family residence.
■ The applicant has obtained a license from the State of California Department of
Social Services to operate a large family day care for up to 14 children. A
deve{opment review is required by the City's Zoning Code because more than
seven children will be cared for and it is located more than 700 feet from another
large family day care home.
■ The day care is provided in the family room and dining room areas. The
backyard is also used periodically during play time.
■ The applicant resides on the property and has two employees to assist with the
day care operation.
• The use, subject to conditions, is compatible with the existing single-family
residential neighborhood.
FINDINGS
A. The large family day care home, as conditioned, complies with the intent of the
State Legislature as set forth in Section 1597.30 through 1597.621 of the Health
and Safety Code which states that "family day care homes for children should be
situated in normal residential surroundings so as to give children the home
environment which is conducive to healthy and safe development."
B. The large family day care home is consistent with the General Plan. The location
and number of children to be cared for will not be detrimental to the health, safety,
and general welfare of the persons residing or working in the neighborhood or be
injurious or detrimental to property or improvements in the vicinity.
C. The California Environmental Quality Act (CEQA) does not apply to establishment or
operation of a large family day care home per Section 15274 of the CEQA
Guidelines.
D. The project is exempt from Chapter XII, Article 3, Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.
CONDITIONS OF APPROVAL
Ping. 1. Use of the garage for day care activities is prohibited.
2. The day care operation staff shall consist of the large family day care home
operator and two employees, as stated in the applicanYs letter of
justification. Further, the day care operator must be a resident of the home
serving as the day care facility.
3. One off-street parking space shall be provided for each non-resident
employee who drives to the large family day care home. The required
parking for the dwelling may be used to satisfy this requirement.

4. The day care operator shall instruct all clients to use on-street parking
areas as a drop-off/pick-up area so that children may be safely loaded and
unloaded from vehicles; no tandem parking or parking a vehicle in such a
manner so that it encroaches into the adjacent sidewalk or street shall be
permitted. The use of the day care operator's driveway for drop off/pick-up
is prohibited.
5. The day care operator shall instruct clients not to do the following activities:
perform u-turns in front of the day care home, double park, block driveways,
use driveways as a turnaround, and honk vehicle horns. The day care
operator shall require all clients to sign a statement of compliance with all
applicable rules.
6. The number of additional trips generated by the project shall not impact the
existing traffic level of service on Fuchsia Street. If deemed necessary by
the City of Costa Mesa Planning Division, there shall be an attendance
schedule prepared by the applicant and subject to review and approval by
the Development Services Director or his designee, which provides for the
staggering of arrival and departure times to avoid traffic and parking
congestion.
7. A copy of the conditions of approval must be kept on premises and
presented to any authorized City o�cial upon request. New
business/property owners shall be notified of conditions of approval upon
transfer of business or ownership of land.
8. The development review. herein approved shall be valid until revoked, but
shall expire upon discontinuance of the activity authorized hereby for a
period of 180 days or more. The development review may be referred to
the Zoning Administrator for modification or revocation at any time if the
conditions of approval have not been complied with, if the use is being
operated in violation of applicable laws or ordinances, or if, in the opinion of
the Development Services Director or his designee, any of the findings
upon which the approval was based are no longer applicable.
CODE REQUIREMENTS
The following list of Federal, State, and local laws applicable to the project has been
compiled by Staff for the applicanYs reference. Any reference to "City" pertains to the City
of Costa Mesa.
Ping. 1. The large family day care home shall provide care for a maximum of 14
children, as set forth in Health and Safety Code Section 1597.465.
2. Signage advertising or identifying this business is prohibited.
3. The applicant shall comply with all applicable State regulations for large
family day care homes.
Bldg. 4. If new construction is proposed, comply with the requirements of the 2007
California Building Code (CBC).
Fire 5. Comply with all applicable provisions of the California State Fire Marshal's
ordinance.

Wate Heater. The permit is valid for 180 days from issuance or
your last inspection, per Section 303 (d) of the 1991 Uniform
Building Code. Should we not hear from you within 10 days, your

required to finalize the permit.
To activate the above permit, please follow these steps:
1. Telephone (714) 754-5626 or 754-5627.
2. Request an inspection; state address, permit number, and type
of inspection.
3. Be sure to have working smoke detector's as required per
Section 1210(a) of the 1991 Uniform Building Code.
4. Have an adult present at the property at the time of
inspection to provide us access.
