Dear Mr. Chavez:
My name is Burt Morgan. I am the City of Costa Mesa's Chief Plans Examiner in the Building
Safety Division of the Development Services Department. I am responding to your letter,
dated 3/28/03 addressed to Mayor Karen Robinson, regarding your concerns over the
property located at 3029 Garfield Ave.
We have thoroughly reviewed the city's files for the subject property. The records indicate
that we have had previous communications with you regarding your concerns about alleged
building code and zoning code violations at this property. You have expressed particular
concern that your privacy has been diminished because of windows on the second floor of
your neighbor's home that make it possible for your neighbor to view your rear yard.
We received your first written complaint on 11/19/90. Your concerns were fully investigated.
City staff reviewed the property files, zoning requirements and performed inspections of your
neighbor's property. An illegal garage conversion was found at that time. With the exception
of the garage conversion, all else on the property was found to be compliant with the city's
regulations. Your neighbor was required to legalize his converted garage by restoring it to its
original condition. Building permits were obtained and the required inspections were
performed on the restoration of the garage.
Subsequent to the investigation performed in late 1990 and early 1991, we received a letter
from you on 10/24/91, expressing your objections to additions your neighbor proposed and
ultimately made to his property. You expressed concerns that your neighbor intended to
build an excessive number of bedrooms as income rentals. Further, you indicated that you
felt the home was too large and incompatible with the surrounding neighborhood. In your
letter, you referred to the home as a"box type boarding house." You alleged that your
neighbor would create parking problems in your neighborhood by renting the bedrooms to
several individuais, each with their own vehicles.
Staff gave ample consideration to the concerns you brought to our attention. However, it was
determined that the improvements proposed by your neighbor at the time, were in

compliance with the development standards of the City. Your neighbor had legally elected to
act upon his right to maximize the development of his home under the prevailing standards of
the day.
In addition to consideration of the proposed improvements, an additional site investigation
was made following the complaint you filed on 10/24/91. No violations were found. Again,
on 2/6/94, you filed another complaint alieging essentialiy the same probiems were occurring
at your neighbor's property. Again, your neighbor's property file was found to be in order.
City approvals, permits and inspections were obtained and perFormed in accordance with the
city's regulations for construction. Additional inspections were performed at the site to verify
whether or not a parking problem may have been created. No violations regarding claims of
an excessive number of tenants or parked cars could be substantiated.
In conclusion, to date, the City has made three investigations of 3029 Garfield Ave. following
actions you have filed with the City. Since the original investigation of 1990/'91 that resulted
in the legalization of your neighbor's garage, no further alleged violations have been able to
be substantiated. Therefore, at this time, it is deemed not to be necessary to launch another
complaint investigation of your neighbor and his property regarding the same concerns.
Nonetheless, I'd like for you to know the following. We have informed our Code
Enforcement Officer who patrols your neighborhood, to pay extra attention to the possible
development of any parking problems that might require our attention. Also, though it may
be of little consolation to you, the development standards for single-family dwellings in R1
zones, have been substantially modified since your neighbor made improvements to his
property at the beginning of the 1990s. Under today's regulations, it probably would not be
possible for a homeowner in an R1 zone to build what your neighbor built.

and other verticai openin�s shall be endosed and [he enciosure
shall be as specified in Section 711.
In nonsprioklered Group R, Division 1 Occupancies, corridors
serving an occupant load of ]0 or more shall be separated from
corridors and other areas on adjacem floors by not ]ess than ap-
proved fixed wired ;lass set in steel frames or by 20-minute
smoke- and draft-control assemblies, which are automutic elos-
ing by smoke detection.
310.9 Smoke Detectors and Sprinkler Systems.

318.91:1 General. Dwelling units, wngsegnte residences and
hotel or lodging house guest rooms that are used for sleeping puo-
poses shall be provided �vith smoke detectors. Detectors shall be .
installed in accordance with the approved manu[acturer's instruc-

310.9.1.2 Additions, altera[ions or mpairs to Group R Occu-
