Because of numerous citizen and neighbor complaints in the area, the Council has scheduled a public hearing to abate this "public nuisance." We are proceeding under Section 203 of the Uniform Building Code which states in part: "All Buildings or structures which are structurally unsafe or not provided with adequate egress, or which constitute a fire hazard, or are otherwise dangerous to human life for which in relation to its existing use constitutes a hazard to safety or health, or public welfare, by reason of inadequate maintenance, dilapidation, obsolescence, fire hazard or abandonment, as specified in this Code or other effective ordinance, are, for the purpose of this Section, unsafe buildings." The Council has set a public hearing on this matter for April 5, 1971. Would each of you make independent studies of this building and document them for this public hearing to declare it a public nuisance. From the Police Department, I will need the number of citizen complaints or actual field checks to this residence. From the Fire Department, I will need a determination as to whether this does, in fact, constitute a fire hazard. From the Building Safety Department, I will need a report as to the condition of the building. All of these reports must be in my hands on Friday, April 2. Hanhart, Building Safety Director Mr. Wakula's house at 1128 Gleneagle Terrace has been in an unfinished con- dition for a number of years. It is perhaps 75% finished and has some broken windows and open doorways. The neighbors have been upset about this for some time but Mr. Wakula apparently does not intend to finish the house until a marina is built in the flats below the hill, as he has reportedly said. We have no code provisions to force anyone to complete a structure nor any provision which specifies how long a project may be under construc- tion. It might be possible to proceed under Section 203 of the Unform Building Code which states in part: "All buildings or structures which are struc- turally unsafe or not provided with adequate egress, or which constitute a fire hazard, or are otherwise dangerous to human life, or which in rela- tion to existing use constitute a hazard to safety or health, or public welfare, by reason of inadequate maintenance, dilapidation, obsolescence, fire hazard, or abandonment, as specified in this Code or other effec- tive ordinance, are, for the purpose of this Section, unsafe buildings." This is a legal quastion for the City Attorney. A public hearing would be necessary, of course. I doubt that Section 5211 of the Municipal Code would have much use here as the car is in the garage. The structure under construction at 1128 Gleneagles Terrace, Costa Mesa (Tract 3470) is in a deplorable condition, i.e., broken windows, unpainted woodwork, refuse, etc., as shown by enclosed photographs taken September 1968. No work has been performed on the structure during the past two (2) years. Mr. Hruza of the Building and Safety Department was contacted by Mr. Norman Slatter during September in regards to the above stated condition. As a result of a visit by Mr. Hruza to the structure and subsequent tele- phone conversations, NO. Hruza stated there were no apparent infractions of city ordnances. During the past year, there have been many instances of undesirable persons being seen on and using the premises for unkno;m reasons. Also, during the past year, two abandoned autos minus engines and transmissions have been towed or pushed to the structure and left on the street, resulting in removal by the Police Department after complaints by residents. At the present time, there is an abondoned auto minus engine, transmission and other parts parked in the open garage of the structure; this auto was pushed there many months ago. The membership have, on their own initiative and money, and with the help of the City Council, paid for installation of sidet:aL'cs, curb;, trees and shrubs from Galley Road into the sub -division to enhance the entrance and homes in the area. Residents have spent, and are spending, a large amount of money for the installation of additions, patios, and sednl�,ning pools, only to have their homes and the area degraded by this structure, which is not in keeping with the type of ho as in the area. All of the houses in the area were custom designed and built, and required building plans to be approved before construction; approval of the building plan of the afore- mentioned structure should not have been granted when compared to the rest of the homes. The Honorable City Council of Costa Mesa Page 2 The building consists mainly of a wooden exterior which has only had a one -;gash coat of paint. The wood is dried out, unevenly joined, and the rear wall of the building appears to be slanted inward. The committee and membership wish to go on record that they: 1. Strongly object to paying continually increasing taxes for improved property, when the utmer of the structure can leave it in a dilapidated condition, decreasing the value of the adjacent and surrounding hones, in addition to not having to pay his share of the tar. assessment. 2. Request the City Council to conduct an investigation into the soundness and safety of the aforementioned structure in its present condition with regard to fire hazard, use of the structure by undesirable persons, or a possible infraction of City Building Permit requirements. 3. That the City Council enforce compliance by the owner to any infraction with a definite given expiration date on such compliance, and that failure to do so will result in condemnation, enforced sale, or dismantling of the structure.
