This letter will serve as Pacific Telephone ' s Encroachment permission
for the construction of a new building under 'ithe existing aerial
pole line located on the southerly six (6) feet , Lot 1.03', Tract 4008
• in the City of Costa Mesa with the following :stipulations : LOTs 9f

1) No fireplace chimneys to be within/ ten (10) feet of
said aerial cable .
2) A distance of at least four (4) feet to be maintained 1-2
between any existing utility pole and the building r�
structure .

3) A charge will be imposed should a rerouting of the r i
existing service wire -be required . •
4) A six (6) foot clearance will be maintained 'between

the roof acid the existing aerial cable if the pitch
is less than' 3/8 . A three (3) foot clearance will
be allowed if the roof pitch is 3/8 orgreater .

The Southern California Edison Company, a corporation, as holder of an
easement recorded on March 8, 1961 in Book 5651, Page 9 of Official Records,
Records of Orange County, California, will interpose no objection to the
encroachment of a building, within the area affected by easement on Lot
105 of Tract No. 4008, as shown on a map recorded in Book 141, Pages 18 to
24 inclusive of Miscellaneous Maps, in the Office of the Recorder of said
County, upon the express conditions:

1. That no portion of the building shall be nearer than two (2)
feet to any pole on any portion of the area affected by said
easement; and,
2. That no portion of the building shall be nearer than twelve
(12) feet, measured vertically, to any existing wire or
conductor of said Southern California Edison Company; and,
3: The owner or owners of said above described property, for
such owner or owners and for his, its and their heirs, exe-
cutors, administrators, successors and assigns, shall and
by the acceptance of this instrument, do release, indemnify
and hold harmless said Southern California Edison Company
from and against all loss, damage, injury, liability, and/or
expense which said Southern California Edison Company may
sustain, incur or become liable for, resulting in any manner
from the presence within said easement area of any portion of
said building.
